Pa still classifies atv's as

All-Terrain Vehicles are defined as follows:

Class 1 ATV - A motorized off-highway vehicle, which travels on three or more inflatable tires and has a maximum width of 50 inches and a maximum dry weight of 1,000 pounds.
Class 2 ATV - A motorized off-highway vehicle, which travels on three or more inflatable tires and has a width which exceeds 50 inches or a dry weight which exceeds 1,000 pounds \

http://www.dcnr.state.pa.us/forestry/atv/registration.aspx

They have not changed the definition of an atv on PA books and honestly i dont think they would.

I have to wonder why someone would put that on Craigslist? What would they get or benefit from it?

Potentially alot of three wheelers listed on CL in PA.

LOL - or the opportunity to pose as a tow truck driver looking for free trikes.

Like maybe looking for responses from people saying - Oh - I have one - who do I call to come pick this illegal thing up?

That is kinda what i am thinking. I read the law with all of the ammendments ( http://www.dmv.state.pa.us/pdotforms/vehicle_code/chapter77.pdf ). I even back checked it. Also the police would never send a tow truck driver to pick something up. The police would have to be onsite with a warrant. Any respectful police officer or tow truck driver would never have done things this way.

Here is the CL post just in case it gets deleted.

honda atc 250r 3wheeler - $100 (western pa)

my buddy had his 3 wheeler sitting in front of his house the other day and a tow truck showed up and said they were called by the police to come confiscate it. my buddy said he was gonna call the cops and the tow truck driver even let him use his phone to call. the cops told him that 3 wheelers are illegal in pa now and if he interferes with the towtruck driver he would be arrested. is anybody aware of this new law banning 3wheelers in pa, making them illegal to own? wtf?!?!?

hey guys, i got an email saying you are discussing what happened to my buddy. smith township police in burgettstown pa are the police who said that if he intrferes with the tow guy that he would be arested. if i had been there all hell would have broken loose and the not only would the police be needed but an ambulance too. my buddy talked to a lawyer yesterday and the lawyer told him that since he didnt have the title (85 atc250r) that it would be tricky getting it back without getting in touch with the original owner. the lawyer is going to get back with him after investigating the matter a little. i would be in jail if i was there! this whole situation is fubar! i just cant believe it, and he was'nt riding on the road or anything illegal????

Sounds like a load of b.s.. Who dailed the number, the tow truck driver or your buddy?
I have a registered/titled 3 wheeler in Pa. I think they would contact owners of registered trikes and let them know if they now were illegal.

I guess you got my email. It wasnt malicous in any way but something like this is what the 3 wheeled community needs to know about and if it was indeed true it is nice to give all the PA guys a warning so they have time to protest, gripe, trailprotrailprotrailprotrailprotrailpro etc etc and stop something like this. If this is indeed true ( not questioning you ) Then it was an unlawful seizure and you have the right to really make some damage and if i was a part of this i would!!!

You have my email so if you need any assistance, chat, whatever. let me know.

Why not someone in PA just give the township this happened in a call and just ask "whats up"...that would clear things up. No harm in a call.

My dad owns a towing service here in Wisconsin...I just got off the phone with him asking him about this situation. He told me if he is asked to remove anything from someones property by the police department, he ALWAYS has a police officer escort him to the property to explain to the owner why there property is being towed or removed. He also said no respectable towing company would show up and say "the police told me to take this" without an officer present to explain the law unless it is a bank reposession, in which case the bank is the owner of the property.

This sounds like it is related to the mysterious "flat track Tecate" episode. Somebody is using diversion tactics to cover their BS tracks! Just my .02 in a long time.

So Joe tow-truck driver is crusing the streets and see's my bike for sale, stops and wants to take it. He hands me his phone ,that he's allready dialed, and I talk to Cheif Wiggum . Really??? I should believe this???? Come-on thats a great scam and the saps who fall for it THINK IT'S LEGAL and don't call the cops on their own. Thats like a water-man scam when he pulls up in a hoopty.Did anyone call the police anyway to see if it was real or was the guy a jerk when he rode it (in the streets, fleeing, etc). My neighbor's a cop and he'll take it even if he saw it in the street the day before or he's off duty. You know the Po Po they make the rules. As for Joe Tow-truck he'd have a cap in his A$S and a dog around his throat.

this is my take on it.... guy sees this trike.. he knows what it is knows what there worth and so on, sooo he has access to a tow track, plans out the call with a friend.. shows up, calls cops from his phone which is actualy his friend, and takes the trike,... and there is 'no proof' it was taken illegally due to no ownership papers..

someone got screwed and screwed good!!!!!

part of the reason i carry the registration cards to all my machines in my wallet at all time!!

Some People........ Im leaning twards BS as well.

may be the scam is to seek out machines that have no title. Pull up with tow-truck and put on the social engineering show. The owner falls for it but has no title or registration to show the cops to prove ownership. So at this point possession is 9/10ths of the law.

But reallly how many people are gonna fall for this? It is also phishing, you never know about responses to the ad.
And how much is an old 3 wheeler really worth? I guess if you get it for free.

Reminds me of the guy in some decommissioned city van pulling in a parking lot of a Pontiac city building and hassling us to pay for parking while we tailgated waiting for a concert to start a couple blocks away. He put up cones and started his act and the people in the parking lot started paying. I yell over to the people he is full of BS and not to pay. Then some chick pulls up and he seems to recognize her, they get in a small argument about "his parking lot" and "he was there first". Hilarious! He avoided the group of us for a few because of my yelling, but eventually he had to bug us for $2. This is a public city lot on a Sunday.

So you want us to believe you work for the city of Pontiac and my truck is gonna get towed? "Yes."
BS. Show me your required by law city identification badge then. "I don't have one."
I know because you are full of sh**. How about you just show me your driver's license then? At this point, he walks off to try to get money from some people who pulled in.
Eventually, he keeps comin back and pissin me off. I told him if he would shut the F up and never talk to us again I would give him $2. So we made a deal.

Just like the guy I encountered this summer (on father's day) who was running people off a lake because they were entering it under recreational trespass via a river. Told some folks as they fled he was a control freak.

Pulled up to us with his wife and kid waving his 5-star wild west badge that I laughed at and asked him if he owned the water. He just kept saying our vehicle was gonna get towed. He never identified himself in anyway of course and even his wife started in with the act. He was full of BS, but he went and loosened the valve stems on 3 vehicles parked by the river. Kinda knew he was gonna pull somethin cause he looked pissed as we laughed at them and a guy from another boat hurled insults at them. That is the risk you run when you stand up to these fun governors out in the sticks. Next time we'll get dropped off and take video and boat registration numbers for a conservation office report.

Illegal seizure. Somebody got duped. Even the police would have to pry my hands off of it. No way in hell a tow truck driver would take my stuff off my property. Was said 3-wheeler parked in a handicap spot?

Thats a scam he will never forget. Owned! I cant imagine being so nieve. I mean common! Call the cops yourself. Take the Lic plate numbers on tow truck! Follow the truck and see were they drop it. Demand answers to the point of harrasment. GET INFO! to many scams out there to trust any jo-blow and really in this situation.

I hate thieves, but it wouldn't surprise me if our buddy Eddie (aka Phill) Rendel and associates would come up with such a scheme. I have all my trikes registered and insured in Pa so I would have to drop my insurance and registration and send in my little blue card check marked scrapped or removed permanently from Pa! Just try and find them!:)
