i took a look at it and i see that the u-joint is detached and laying in the rubbber boot so do i still have too remove the swingarm to remove it and replace it?

you could possibly destroy the boot getting it off and slip the u joint through the crack, but when you go to install it youll never get it back together.
so yes remove the swing arm. the whole rear diff, axle and swingarm can be installed as one unit easily.
