View Full Version : Disturbing Read in the Occupational Health and Safety(OH&S) Code Book Today

Here's whats written

"All-Terrain Vehicles and Snow Vehicles
280 A person must not use a three-wheeled all-terrain vehicle at a work site."

The OH&S code book is a federal document that is used by employers and workers as a reference for rules, acts, exposure limits and regulations to protect workers from workplace accidents.

My questions are; does the same type of code book/document exist in the US either federally or by State? And does it mention three wheelers?

Yes we do. It' called O.S.H.A (Occupational Safety and Health Act) The following are excerpts from the OSHA ATV Regulation's:

This Safety and Health Information Bulletin is not a standard or regulation, and it creates no new legal obligations. The Bulletin is advisory in nature, informational in content, and is intended to assist employers in providing a safe and healthful workplace. Pursuant to the Occupational Safety and Health Act, employers must comply with hazard-specific safety and health standards promulgated by OSHA or by a state with an OSHA-approved state plan. In addition, pursuant to Section 5(a)(1), the General Duty Clause of the Act, employers must provide their employees with a workplace free from recognized hazards likely to cause death or serious physical harm. Employers can be cited for violating the General Duty Clause if there is a recognized hazard and they do not take reasonable steps to prevent or abate the hazard. However, failure to implement any recommendations in this Safety and Health Information Bulletin is not, in itself, a violation of the General Duty Clause. Citations can only be based on standards, regulations, and the General Duty Clause.

The following is the only reference to 3 wheelers:

Three-wheel ATVs have not been manufactured since 1988, but older three-wheel ATVs are still in use. While the stability of ATVs as a whole is low, the stability of three-wheel ATVs is generally worse than for four-wheel ATVs. Cornering and traversing slopes on three- wheel vehicles can be particularly dangerous.

I rode on a three wheeler at work today. Two up and the safety people say it's OK! We have a lot of three wheeled vehicles around the plant, Cushman scooters, Taylor-Dunn, and EZ-Go all make three wheeled vehicles for people such as myself to travel around the plant.

Edit: alot of the maintenance crews ride pedal tricycles with their tool boxes on the back to! It's a three wheeler nuts dream around our operation. Makes me smile!
