Walked my dog last night, car came blinded me went to walk up on the side walk of a new construction home in my development...next thing i know im sitting in a trench of electrial wiring...broken foot. Car stopped to help me. Went to work hurt like hell, called foot ppl went in, and walked out with a broken foot and cast. Went back to work.

Guess i can redo my bikes for 2017 now. I called lawyer already. Ain't no reason they hole needed to be there, should of been taped or a flag.

Got a cool cast!!!!! I flip atvs down 300ft hills, landed them in trees, run my legs and knees over with atvs and trikes 15 miles from truck...and i get hurt walking a dog 8 homes up the street from mine. Least I got a desk jobs and lends to alot of ebay and youtube! I am going to miss the gym now UH!!!!!!!!

How I have to sit at home with a prego wife...maybe on Sundays Ill just go down to Chipolte and make 4 stroke sounds.

Bad luck for sure. I heard the government is going to outlaw dogs because they are so dangerous (JK). On a more serious note, I wish you a speedy recovery.

The cast isn't the worst part, it's when you get it off and you have to use it again after no movement for two months and getting strength back.

On the bright side if you win in court you might get to buy a shiny new bike. Good luck.

Heal up quick. Same thing for me. I've been riding for over twenty years, no issues. Broke my ankle on a waterside at a pool party. Go figure... I was down for 6 weeks.

That sucks. I hope it heals well, and quickly. Also, be careful when you get back on the wheelers after recovery. You should be getting that cast off just about when the snow is starting to coat everything. Don't go rushing right out for a ride and biff yourself up again on the slippery stuff.

I feel your pain man. I broke my fibula back in August. Crashed on my dirt bike (ironic since I have much more "dangerous" three wheeler that stayed home). Still have some pain but now starting to walk normal. I think I'm a little older so you should heal up a little quicker. I'd say play the broken foot card for all its worth but I think your wife's prego card trumps ;-) (Congrats BTW) It will go by quick and you will be back on your feet.

Well that sucks but at least its not summer! Listen to the MD and do physio as prescribed. As lame as it seems it will help especially as you get older. Heal quick!

If someone is doing construction and digs a hole in the middle of the road and doesn't follow regulations put in place for SAFETY and you drop your car in it and you are left with the hefty bill to get your car pulled out and the repair cost, id be trying to get some compensation too. I'm not saying that's comparable but it's the same concept.

Again, I'm not saying going through a lawyer for this situation is what I would do, but to each their own. Who said he's in it for the money? Maybe he just wants to assure it doesn't happen to anyone else and something more serious happens? Think before you speak, that's all I gotta say.

The trench was right off the curb. New homes under construction here have no side walks just grass where it would be, thats what I tried to walk on to get off the street when the car came. No street lights or flags or caution tape around that trench, so when grass is 8 inches tall at night you don't really see whats behind it. It what is is I guess but a few people said it should of been marked. I went back and looked what I fell into...a nice wooden piece cut in a triage is what my foot warped it's self around. When we build our house they praised themselves for not having house trash lying around on scrap piles like you do see a lot. My riding buddy said it seems like a slam dunk for a new shiny quad, 100ft yacht and strippers lol......I'll see where it goes. President of my company said I better sue also.

Because of this now every atv I have will get nerf bars and such as much as I do not like them now I don't even wanna chance sitting on side lines again.

I am just going to slowly sit in the garage and rebuilt a YZ250 motor

Sorry bout your foot..

My own cousin tried to sue me..that letigious stuff dont even surprise me anymore....and she is a underwriter for a huge insurance company. She was loopholing and trying everything to push it through and on the clock I might add even...I like people...

At least this prick doesn't sue people for my own mistakes! Put a builder out of business and mess his insurance up when you should not be on his property in the first place. People like you are the problem with this world and should probably just keep your mouth shut! I figured this was going to get divisive when I read the first post. The "sue" word made me cringe.

I've been sued, my father has been sued and a few of the places I've worked have been sued. Every freaking time it was some useless POS looking for a payday. Fortunately we've always won (if you can call it that after legal fees). On the other hand I've tripped on an extension cord in the dark that someone run out the door of their motel room and over the sidewalk to charge a battery, taken my daughter to a hospital after a teacher left her alone on a slide at the age of 4 and she fell on her head and passed out. I slit my finger open on a broken latch spring on an airline overhead bin latch, bled like a stuck hog and politely walked off the plane even though the stewardess was insisting that I should report the incident and maybe "get something". I told her that all I wanted was for them the fix the latch and left.

So why didn't I sue anyone and get a payday? Because no one wanted me to get hurt, sh*t just happens.

That sucks. I got hurt at work on may 31. I put on 31 pounds since I left the hospital. I've got one more surgery to go thru. Then it's gym time got me. Heal quick and do what the doctor says.

True, true , but at least with the don, we can still buy a gun, shoot our own self in the foot from ignorance, and still be able to sue the manufacturer...rod ham gets in and we will get sued for not having trans fag trailprotrailprotrailprotrailpro rooms....

Lawyers suck. Just a mere 30 -40 years ago a simple ass beating solved many disputes...

So on topic-

None of us were there. I'm not advocating suing, not taking either side, just some common sense points......That said:

1. City/Township/County/State Right of Way along roadways extends a certain distance from the center of the road. In my Township it's 33 ft from center of road. WELL past the curb line if we had a curb. I highly doubt Mr.oldskool was trespassing.

2. If a contractor is stupid enough to not blatantly and very visibly mark and/or protect a trench he dug that will be left overnight, he's an f'n moron. Especially if it's a trench on a new property in an established neighborhood were people are living. To me, it doesn't matter if there are rules or laws or not (I'm quite sure there are), it's plain friggin stupid.

3. I walk my dog on weekend mornings between 4:30 and 5:30 in the morning. I live in the sticks on a small rural 2 lane roadway with no shoulders, no street lights, and fairly deep ditches on both sides. On moonless nights, it's just by stars, not even that if it's cloudy. I have no problem seeing 10-15 feet in front of me in the pitch dark, and I'm old as dirt. If a car comes by I switch to the opposite side of the road, flip on the flashlight on my phone and shine it indirectly in their direction, stop walking and make my dog sit at my feet. I ain't been hit yet.

LOL at the member b!tching about someone suing, yet lives in the most liberal, rule and law burdened nanny state of our Republic, bitches about and doesn't move........

If I could of seen I wouldn't of walked there. When the came up over the ridge of the road at night the lighted blinded me so I moved over...what looked flat was not flat when I stepped right off the curb. It's that simple.

I have a meeting with them Friday. If I have no case then I dont, If I do I'm gonna run with it. I am not trying to get free stuff cash because I am greed or broke. Just done do construction and leave crap ppl can trip or fall over.

50ft down the street is a walking trail the builder made...the put in a handy capped ramp to meet the road. Guess whats in front of the handy capped ramp...a freaking 1ft x 1ft x 5ft trench then it's the main road...not one flag or caution tape.. That's just another accident waiting to happy to someone.

It's just dumb that's all and its been like that for 3 months. I don't use that because I don't feel like tripping but it stupid stuff like that that hurts ppl or little kids.

Like me or not I could care less. You didn't break you foot. I did.
