I was recently contacted by a friend who asked if I’d received my shock back from Milner yet, the answer was “no” as he has had it for over 15 months now. He then mentioned a friend of his was out parts and money with Milner as well and it occurred to me that someone else on here is still waiting for parts as well.
While the sum of my money, parts and shipping is shy of the price of a lawyer I suspect the accumulated values of all our parts is probably high enough to justify taking legal action against Milner and if nothing else might get us back our hardware.
I have a bit of previous experience with matters like this and I’m more than happy to do the leg work if I can get enough people to come forward. You would need proof of shipping as well as PayPal receipts and any emails or texts would help a lot.
I’m NOT going to contact anyone directly to ask you to participate in this. You know who you are and some of you may still be hopeful that someday your parts will arrive to your home in good condition. I understand that and respect it as I too was in your shoes for a few months, but if you are interested in reclaiming your property please send me a PM and we’ll go from there.
I can’t promise anything, but I suspect that if enough of us get together and chip in a few hundred bucks each we can get a lawyer to either accumulate our losses to sum over $5,000 (a felony in AZ) and get charges filed, or perhaps represent us in small claims court as a group. At this point anything is better than nothing and seeing Milner out and about at the races in the light of day tells me that he feels he’s safe from repercussion.

I don't know of anyone off hand that isn't already on here. I'm sure there are a few who have probably chosen to keep it quite like a lot of others. I unfriended him and his mouth piece some time ago so I have no idea what he's been up to on there.

Fortunately I was one of the lucky ones for some reason and the only thing I can think of for getting my parts back is because of my profession? I'm honestly completely EMBARRASSED to have ever defended this guy as much as I did. I'm usually a good judge of character but this guy totally fooled me.
I was asked to stay out of it and I did. I had hoped he would AT LEAST APOLOGIZE, RETURN A F@#$NG Phone call, or MAKE AN EFFORT TO RETURN PARTS AND/OR MONEY.....but he didn't attempt ANY of these avenues. Oscar was nominated mediator I guess.
Although Milner did exactly what I paid him to do with a two week turnaround three years ago, the ppl he is holding hostage and RIPPING OFF are my friends and when you steal from friends, you steal from me so this guy can eat a bag of DICKS because this is beyond cowardly and pathetic.

I have not been defrauded by this person and El..........what you are attempting is noble. Trying to get your money back/items and helping fellow victims is admirable but what you are describing maybe cannot be done.
There is no......what is essentially a "class action" in small claims. And grouping a group of ......let's say "defrauded folks" together to go over $5000 is not how it works. Every instance is very individual......and it's own contract and not tied into any other....... so each instance is its own cause. Trying to prove "fraud in the inducement" will be very difficult since there is a history of "satisfactory performance" with multiple people. This is all Tort law and will only be solved with civil litigation.
Everytime I read something about this guy not giving items back I always think........... why doesn't anyone take him to small claims court? After all i feel this is the only real recourse.........and a lot cheaper than an attorney. Each state has its own laws governing small claims court but one may be able to file in his home state. If that's the case you will almost certainly get a judgement in your favor because it's unlikely this person will show up. Enforcing the judgement would be the next step. All this way cheaper....even the serving to appear........than hiring an attorney.........and cleaner and enforceable.
Or you can just write it off and keep everyone informed of said persons untrustworthy nature.

I hear you Knappy. I don't doubt that each of us would have to take him to small claims court, however I am hoping to find a lawyer that can build a cookie-cutter template of the issues and simply change names, values, and description of items in each rather than start from scratch on every case. There is another option as well that we use in our day-to-day business that I would prefer not to elaborate on here, but thatis the One I am going to pursue first.
If all else fails I will take it upon myself to inform the IRS, the EPA, and any other regional bodies then may govern over those who conduct unregistered small businesses in their homes in that area and see if I can get him fracked that way. One way or another he will regret screwing me over.

She deleted the post a short while ago but the person reposted again . I think her page should show up if you click on the link . I don't think you need to be a member but I'm not positive, however, if nothing appears when you click the link, you do need to be a member . As most people here probably figured out, I don't do social media or chit chat much so I really have no idea how it works and have absolutely no clue what i means when people preface a comment by saying hashtag first. :(
The person reposted it every time she deleted it yesterday so she is obviously watching her page closely . Must have her a bit worried at this point . I also saw that oscarmayer posted on her page yesterday as well.

Ok, I checked it out and it looks like you need to sign up for facebook to view the page . This can be done in around 2 minutes . You can use most any typical name so you don't need to use your own . You will need to provide a phone number or email . If you don't want to use your number or current email you can make a new email account for free on mail.com in around 1 minute.
No phone number or other email is required to get an account at mail.com and you can make several accounts there if you need . After you sign up at facebook, go to the email site you signed up with and open the email they sent you . After you do this you are done . You do not need to fill out the facebook profile or security questions . Once those pages appear just skip them or close the window and go to facebook.com then enter milner brown in the search window at the top of the facebook home page then click search . It will pull up several milner browns . He is the one nesr the top of the list with the logo he was using on here . Click on her name and her page will appear . Go to the small down arrow on the right and click on it and a small box of options will appear . Click on videos . This is where the comment section is . here are no comments in the photo section . The newest comments are at the top of the page.

Ok, I just had an idea but am not certain it will work . In addition to being able to delete comments, I think she can also prevent people other than her "friends" from posting comments . If this is the case, the posts regarding her ripping people off will likely soon stop appearing so my idea is this . Facebook allows people to have an image/avator/photo etc . This appears along with the persons name when you do a search for a name . When I searched for milner brown, several of them were listed and most had an image of them or a logo next to their name so someone might be able to copy and use the logo she is using and use the exact same name since several other people have it so when people do a search for milner brown 2 identical ones will appear and they will not be certain which logo to click on so they might click on the "replica" and this page can contain the theft information . Unfortunately, not many people are likely to see it because his current "friends" already have him in their file so they just go directly to his page and will never even know about it unless someone tells them about it, but at least it is a free and easy experiment if someone wants to try it.

You may be right, but, as you also pointed out, each state has its own set of rules. Keep pushing El. I think your highest hurdle will be getting heard. From the courts perspective, this is a turd. Just a mire of transactions across different states with different interested parties. If the court can punt on it they often will. Remember, laziness carries the day in all things judicial. Its going to be on you to make yourself heard. A continually squeaky wheel will eventually get the grease. It will have to be more of a pain in the arse NOT TO deal with you than it is TO deal with you. Then you'll probably get some justice. It won't come cheap and it won't come easy. In the end, receipts, paperwork, emails, and affidavits will carry the day. Not the ramblings of what the court will view as some red-neck complaining about something almost every judge will view as frivolous. I don't agree with that, but it is most likely to shake out that way. If you battle for two years to get heard, you'd likely have 5 minutes total argument time. Not enough to make a rational argument. The pen is, like, stronger,,,, or,,,um, better,,, ummm ,, than something,,, or something.

Once a suit is filed in small claims it is most generally heard within a month. Every person here has an open and shut case. I am no lawyer,nor know what all El has done in the past,but filing all of these cases back to back with one attorney,,,yeah,,that word........yuck.. Would most likely result in him being able to represent each one of you on an individual basis in one day. Case after case after case,individually. This I know could be done for a fact, and VERY swiftly. I also think most attorneys would really like this as one good day of work,,maybe cut you quite a break on price. Frankly, if I was any one of you and were to LOSE money getting justice. I DAMN sure would! But that's just me. Where I come from this kind of manure is simply not put up with. It is dealt with very quickly and swiftly. I hope you all get a plan together and get this done! Find a "decent attorney " in his town,so there is no travel involved. Get him every shred of evidence you have and have him file. With El heading it up,it should be almost painless for the rest of you ;)

by chance do you think they took the shocks did the work and sold them on ebay as rebuilt shocks to get major profit? I wouldn't keep items someone send me unless I was going to sell them, what's the point of keeping so may shocks and cash then...highly dought he or she has some awesome builds going. Unfortunately I have had to sue a few people including the State Of California, but fortunately I won every case and I did it without a lawyer or any legal advice . The State sent three attorneys to defend it against my whopping $800.00 lawsuit, lol . Anyway, I figured since I too had some experience with this type of thing and may (or may not) have lived in Arizona for a while, I would do a little research for you and hopefully get you a decent starting point . Some states do not even allow out of state residents to sue people in small claims court so this would be one of the first things to find out.
Below are just some of the questions I would ask and whomever you talk to will obviously offer other info.
Can I sue someone in Arizona if I live in another state?
Can a lawyer represent me or do I need to appear in person?
If I win the case and he does not pay, what are my options?
Can I file a lien against his home and/or personal vehicles etc?
If I can file a lien, how do I do that and what does it cost?
How do I find out what he owns so I can put a lien on it?
Does the suit need to be filed in the county the defendant lives in?
The county question is important because if you can sue him in a county that is hundreds of miles from where he lives, it makes it far less likely that he will appear, and if he does not appear, you automatically win by default because they do not grant extensions or a change of venue/location in small claims courts as far as I know.

If he won't return a call, text, answer his front door, send back a shock, send back money, at least apologize, attempt to explain, or so much as send a representative to do so on his behalf would be a good indicator that he's a no-show in court too.
Now I've never been sued for shock work but I've been sued for a medical bill and when I didn't appear, the plaintiff was automatically awarded a decision favorable to them. Hopefully it will be as easy for you guys.

Honestly..........filing in small claims is really the only way but also the easiest. A retainer for an attorney is probably $1500.........not counting court and prep time......simply not worth it for shock absorbers.
Since El is in "Meh-hee-co" and seems to travel a lot it may be easiest for him to file in AZ. There's ways to do service but nothing is as effective and daunting as a law enforcement officers doing the "service". Its more $$ to have them serve but if you win then he will have to pay for that as well.....so since hes going to do the paying you might as well have the best and spend the most. Heck.....if he doesn't answer the complaint you win by default and never have to set foot in a courtroom. It's simply the easiest way to go and if one person gets a judgement then that sets a precident for the next complaint.

Yes, pay to have it served by the Sherrifs office. Every cent of that gets added on top of the judgement. Much better that way ;) Like Barnett I have also had an idiot for a client { myself} A few times and have had an absolute BALL drowning lawyers at their own game :) Undefeated so far .

My father was sued once. The Plaintiff didn't do certain things in the correct timeline which should have ended the whole ordeal in dads favor immediately.
They would not allow my dad to show pictures of who the real culprit was, and the judge didn't like the fact that my dad wrote everything down in print rather than a typewriter or printing his answer off a computer.

In the event he sees this and decides maybe this is actually not going away ;). Maybe he'll start mailing boxes of garbage back to you guys. If they aren't fixed as you discussed that is still a breach of contract. To be whole you will still need the cash to have them professionally rebuilt somewhere else . Damages for the time you have been without a ride etc. Each of your individual cases would be different.

Huge lawsuit? LOL! I wish. If we could sue him for pain and suffering they'd award us millions, but I don't think it works that way.
Milner: When you read this know that if my shock and spacer were to arrive at the address I've sent you multiple times I'd back off. You can keep the money, you seem to need it more than me.
You can also put all the other 3WW member's parts in the same box and send them to me and I will make sure they get to the rightful owners, saves you having to pay shipping with money you've already spent. Think hard and fast about this as I am willing to spend more than you owe me to get your name permanently etched into the loosing end of legal text just to say I did.

How’s it going? I saw you on here late last night, again this morning and again just a few minutes ago. You sure do come around a lot for someone who never posts anymore, what’s up with that? Anyway, seeing as how you don’t seem to respond to texts and calls much I thought I’d post this up here where I know you will get the message.
I had a very nice talk with a lady at PayPal’s Fraud Department this afternoon. Seems that after what transpired between you, my buddy Bruce and I last year your PayPal privileges were revoked and your known data was put into a database of some sort that monitors for similarities that would indicate the same person was trying to conduct business through another account. I sure hope this hasn’t posed too much of an inconvenience for you as I’m sure you would have liked to continue receiving (insert Dire Straits song title here as I know you love Glamy style posts :Bounce).
Once I explained what’s been going on she told me that PayPal has a policy that allows Plaintiffs including those seeking justice in Small Claims Court to subpoena all the transactions of a Defendant through law enforcement. If I understood her correctly this means that anyone who wants to take you to small claims court would be able to pull up your entire PayPal history including where people have successfully gotten PayPal to rule in their favor against you which helps set precedent.
She also mentioned that while people who were coerced into sending funds to you via the “Friends and Family” option were not protected under PayPal’s policies they should be able to get compensation from the Court as fraud is still fraud regardless of how the funds were sent.

Look closely at the way they are carefully sorted and stored in the order they arrived :lol:. You will also notice that there is a ground cable on the table indicating that someone has likely been welding recently. Anyone who has welded for any amount of time knows what happens to chromed shock shafts when weld spatter gets near them, yet there they are right below the ground cable.
No wonder he can’t return sh*t, it’s probably ruined, or misplaced. If only we’d know what his shop habits and business practices were in advance.

As provocative as a good old fashioned curb stomping sounds I doubt anyone would want to pay for his facial reconstruction over a shock. Looking at the mug in that photo odds are he'd try to get the doctors to fix the birth defects at the same time and include the upgrade in the final bill.
I'm surprised you've never heard of him. He's the suspension guy to the Stars of MX and Enduro, worked on an F1 team, does consulting work for most every suspension manufacture I've ever heard of including Marzocchi, Works and Kayaba AND is reputed to work double shifts at a mattress factory. I'm sure he'll be inducted into the Suspension Hall of Fame any day now.

I will say this. They say karma is a trailprotrailprotrailprotrailprotrailpro who cannot be outrun. I have watched first hand the last couple years to POS's getting theirs,and it almost hurts... One has lost his leg, twice,and now the other one needs to come off. One is mentally and physically just a pile of ,,,well,,crap. He just bumbles around with his wife caring for him. Their victims point and laugh ,but I still feel kinda sorry for em. It is rough to watch. I know at the moment it is no solace,but they will get theirs,and when they do,it will be ten fold. It Always is.

Well i guess I'm late to the party, I sent him money and my Tecate 3 shock, all kinds of excuses, double shifts, waiting on parts, blah blah blah, he also told me he is going thru a divorce and didnt want his wife's lawyer to see his paypal acct and asked if I would send the money to his friends acct, which I did, unknowingly of course, so please count me in as one of the people he has swindled, not sure what to do now, I don't come on here all the time so I didnt see the post about this, I can't even find a good T3 shock, its not like it was a 250r shock which are a dime a dozen, he hasnt responded to me since June 5th, now I know why.

Do the world a favor and contact PayPal with your story. At that point they may freeze his buddies account and maybe even be able to pleasure him to force Milner to ship your parts back. To those seeking a real life example concerning Milner Brown of Sic racing in Arizona, I have created the timeline below outlining factual dates/monies exchanged. This is in no way to be defamatory. Rather, this is to inform those that have their property with this individual or are on the fence about using Sic racing services. I want to thank those of you who have helped me behind the scenes, you know how much time I have invested in this debacle and what I am going through personally which makes this even more important to share. You guys know who you are and will forever be aces in my book. Also, a personal thank you to Rob Selvy for allowing me to post this on his FB page and who has enough sh!t stacked on his plate to choke a donkey but is briefly pushing it aside to assemble these shocks because, well, that’s the kind of guy he is. Thanks Rob!
1. Initial purchase of works triple rate shocks (March 30th 2016)

2. I contact Milner Brown asking if the shocks can be rebuilt and valved for my weight and riding style. I also asked that the springs be powder coated black/yellow and shock bodies anodized black. Milner said all labor could be done for $190.00 which included any parts that needed to be replaced. My original need date was Little Sahara Oklahoma trip October 2016.
3. Shocks received by Milner April 13th 2016 and Pre-Payment made for Shock Work (May 9th 2016)

4. I contacted Milner Brown October 2016 to see if shocks were complete and he said they were not due to family issues. Respectful of the issue, I didn’t contact Milner Brown again until January 2017 asking if the shocks were still in work and Milner said that he was currently working on them. I told him that I was going on another ride in early March and would need the shocks by then. Milner agreed that this wouldn’t be a problem.
5. March approached and I text to inquire about progress. Milner states that his powder coating equipment is down and his local, Arizona PC Company is 8 weeks behind. We decide to have him ship the springs, bodies, piggy backs, etc. to my local PC Company, Gateway powder in St. Louis.
6. Milner shipped the works triple rate shock pieces to Gateway Powder coating February 27th 2017.

10. This is how the shocks were received on my doorstep June 23rd 2017. I didn’t find out they had even shipped from Milner. A friend of mine inquired with another individual who had said Milner had shipped them. In fairness, I didn’t care how they arrived. At this point I was tired and frustrated. All I wanted was my property back from being gone for 1 year and 2 months.

Man...I feel EXTREMELY lucky! I think I may just be the ONLY guy to get his shock back from Milner in one piece...
I will say that it took a LOT longer than I expected (six to seven months), but I wasn't in a hurry as my rebuild went really slow anyway.

Not legal, but funny as all heck. Here is a photo of the letter he sent back with my buddy's stuff after he threatened to charge him with theft over $5,000.

Note that he claims to have removed all the parts and put the old oil back into the forks (That he saved for 4 months?) He also claims he didn't touch the shock, which is true, as it arrived back in the same wrapper it was shipped in. Thing is he claimed earlier that it was totally done with the latest GP specs and just needed a spring. Oh, and the spring he claims arrived just before the threatening email, well he told me he had it weeks earlier.
Oh, and that paypal address request? He was sent it a half dozen times and never replied. That's why he no longer has a paypal account.
I guess we'll sit back and wait for Oscar to defend this latest proof of Milners bullsh*tery as we all know that Milner hasn't got the nut sack to defend his actions.

When all this crap started to culminate, Milner said in a post/text/email SOMEWHERE that it would "be his last Thanksgiving" with his wife.
I thought - Ahhh this makes sense!!, I told him I understood as I was a wreck when I lost my wife, and he responded, - "I'm trying to figure out/understand your message, but, all is well here??!! - I don't understand" and I didn't follow through.
He had already sent me my parts for my forks and I had had zero issues with him. So, at one point or another, I merely shared my experience which was positive.
Son of a beyatch!! - Why would he do this? What does he gain? We all have friends everywhere!! He's only hurting himself...
