I've been emailing him and requesting totals and today I get this email:

Just started to pack the shock for despatch and noticed that it was sat in an oil puddle and that there was a small crack in the top housing of the shock where the screw for the reservoir bolts in, I don’t think that it is fair, so I wont send you the shock in this condition, as I am a good Ebayer and have received parts that are damaged I know how frustrating it is, I had exactly the same thing when I bought a set of front shocks for my other quad and they cost me nearly $1000 with shipping. I will understand if you want to leave me negative feedback but I hope you don’t because as I said I am an honest Ebayer, I have one negative feedback and that was from a guy that stole my money and didn’t send me the goods.

David

I am very sorry

 I think he's full of ****. So I called him on it:

At the cost I won the auction for, it is still a bargain and worth me buying and sending to Elka to have the problem areas fixed and replaced. I am still interested in the shock even as it is, lets make this work.

Billy

I'll be suprised if he even replies. Damn I knew that was to good of a deal to be true. Quickonstep anyhow

I agree. He is bummed because he didint get the price he expected, and you are right that its still well worth it, even if it has the problem he described.

HOLY SHITES!!!! A "C" note to ship?????? I've sent whole engines for less than that!!! Don't you hate it when you just want to tell somebody to get F'ed but you can't because you REALLY want what they have!

Billy Golightly
03-18-2005, 07:14 PM
Well, the guy is in England so the shipping isn't that much out of line. Heres what he emailed back to me.

Sorry but even if you think that it is bargain I still do not feel that I should send it to you as it really is not fair, you bided on an Elka shock that was in working order not one that was damaged. Sorry again hope you understand. I will understand if you leave me negative feedback after this.

David

Look man, I have my doubts that the shock was damaged. I figure your dissapointed in what it brought and don't want to sell a $800 shock for $200, I dont blame you. So lets shoot straight here then, what are you looking to get out of it? I'm interested in the shock, and its obvious you were/are interested in selling it. Lets make the deal work.

Make damn sure you count out exactly 89 days 23 hours and 55 minutes from the end of the auction so you can leave him negative feedaback without him giving it back

SOund like a worthless sob to me

I mean really, what else can I do? Sucks...that shock should be mine

I'd drop him negative feedfback in a heartbeat if you don't get it. He "fully" disclosed it to you, you still want it and he wont give it. I'd try sugar for about 2 weeks and then that's when I'd start dropping the threats. That's when you tell him he's got 1 more week to get you a tracking number or he get's negative feedback and you report him to ebay. After that I'd walk away. Wether you get it or not now he's earned a neutral feedback for trying to jerk you around.

Billy Golightly
03-19-2005, 10:39 AM
I don’t want to sell you damaged goods, but there is another one on ebay that is selling for less than it would cost you to have this one shipped and repaired, if you want to leave me negative feedback ok then, but I hope you don’t because as I said I am an honest Ebayer, I have one negative feedback and that was from a guy that stole my money and didn’t send me the goods.

I was selling it for a friend, I can send it but I would want you to leave feedback first so you don’t say that “I sent you damaged goods and don’t trust this Ebayer”

The choice is yours and the other shock looks nearly new.

david

Hmmm...So What if I send him $300 and then I dont get anything back at all? I mean, I haven't sent him money yet. I wasn't going to until I heard back from him on the totals so as of now I'm not really out anything but some time.

I guess I'll write him back and ask him to get some pictures of the damage and I'll think about it.

Ok, now thats ALMOST believeable except I had my doubts so guess what? I checked the Senders IP address in that email and all my previous ones, exactly the fricken same. His ebay username just changed today. I'm looking him up on UK telephone searchs now. I'm gonna bug the hell out of this asshole. I would have taken it alot better if he just said "Hey man, I'm gonna lose my ass on this shock if I sell it. Heres what I need out of it" instead of giving me a whole damn run-around.

LMAO! This guy just keeps digging deeper with the lies. Id contact ebay. They'd be interested to know his account was hijacked. This is the first time i ever heard of an account being hijacked, where the hijacker would not accept payment. Most of them want payment, and then dont send you a part, not the other way around!

Billy Golightly
03-19-2005, 11:14 PM
I think I'm going to go ahead and paypal the $305 to him and then use the paypal buyer protection thing and say "See! I even sent you the money for it and you wouldn't send the shock to me you scammer!" That would really put him in a bad spot. What do you guys think?

Billy Golightly
03-19-2005, 11:40 PM
Money has been sent via paypal. I will probably be out $300 but right now I dont really give a ****, he's pissed me off and its more about principle now then anything else. Here is the email I just sent to him also:

Well evidently your ebay and email addresses were not the only thing broken into. I would reccomend checking all the windows and doors in your house because the exact same computer that sent this email also sent me all the previous ones including my question to the seller before the auction even ended

This email: Received: from homeb4qd5zsy0d ([82.36.241.191]) by smtp-out6.blueyonder.co.uk with Microsoft SMTPSVC(5.0.2195.6713); Sat, 19 Mar 2005 20:40:48 +0000

Furthermore, your ebay ID had never been changed until today. It was vodkamonster31 from July of 2003 until today, where it changed to "Isalamalecu". You have left positive feedback in other transactions as late as yesterday. Cut the bullshit, I was not born yesterday and you are not going to pull one over on me nearly that easy. I've sent the money, I know you've got the shock broken or not. Ebay is a legal and binding contract. I have fufilled my end of the deal by sending you the money, it is now your turn to fullfil yours by sending the item that I rightfully own.

I hope your not out your money. The good thing is that since Ebay owns Paypal now they know you have sent payment. So he can't file for Non-Payment. hehe

Hey Billy,
normally I´m not the guy that gives up really fast, but save your time and money and let this ***hole keep his shock in the UK.
He will not sell it to you and there is no way to make him sell it.
I had the same problem with a lonestar swingarm and a guy from austria.

eBay will not help you in any way !!!

Even if you would take him to a court, he could still say that the shock was stolen from his garage and you could never prove that he lies.....

That´s the way it is, I understand that you are f*cking angry, but you can not do anything.

3 weeks ago I visited an undiscerning eBayer that I had some probs with,
the result is that the guy filled a threat complain and the things don´t look good for me........................

Maybe you send this guy a nice virus on his computer, just for revenge
And bid on his further eBay auctions with a new account, that´s what I will do too.

Ok, what else can I do now? How/Who do I contact at ebay?
Here is one option:
http://www.squaretrade.com/cnt/jsp/odr/overview_odr.jsp?marketplace_name=ebay&campaign=EBY_OD_1

After 10 days you can file here:
http://feedback.ebay.com/ws/eBayISAPI.dll?InrCreateDispute

This page backs up Green Boy's posting:
http://pages.ebay.com/help/tp/programs-investigations.html

What eBay does not investigate

There are many things the Investigations department doesn't investigate, including simple misunderstandings, failure to communicate, and interpersonal disputes over which eBay has no control.

Here are some examples of what eBay doesn't investigate:

The seller refuses to answer my emails, they will not acknowledge my valid transaction, or they have already sold the item.

eBay cannot force a seller to honor their transactions. You should leave appropriate feedback for the reluctant seller to warn other buyers of his or her past history. Depending on your local jurisdiction, you may have independent legal recourse against the seller.

eBay cannot force a buyer to honor the transaction. But you can alert the rest of the eBay community of your experience by leaving the buyer appropriate feedback. You may also either offer the item to the next bidder or you may relist it and request a credit for the Final Value Fee.

Basically they are saying your on your own. We ( ebay ) are only here to collect our money.

Hope this helps.

well I made a post on the ebay forum, and was directed to a form you fill in if you have a "Non-selling seller" which I filled out and sent. Suppose to have a reply in 48 hours. I'm not going to get negative feedback from this asshole so I'm gonna wait till the last day then leave it like someone else mentioned.

Does anyone know, that if I do that thing to watch a sellers auctions if it notifies them or shows up anywhere? I want to watch his auctions and see if anything comes up in the future.

I don't think a seller can find out who is watching there items, or at least I've never been able to see who is watching mine.

Yes, you can watch this sellers acutions and have any new listings emailed to you. It's really easy actually. Check his other auctions ( http://motors.search.ebay.com/_W0QQsassZlsalamalecu ) and then add him to your favorites, be sure to also have them email you when ever he list anything. ;)

Read the email from ebay in the post below, and then this.

I have proof that the person sending me the emails I received before the auction ended, are the same as the person who emailed me after the fact claiming their account was compromised. I have personally reviewed the headers for these different emails and the originating IP address is the same, right down to what the computer was named during the windows installation. I have included the first email I got from Mr David Webb after inquiring about shipping charges. I have made the portion of the header containing his IP address in bold to make it easier for you to see:

Hello

=20

I don't know who you are, and congratulations on winning a Yamaha rear =
elka
shock?=20

We have just returned from a two week holiday to find that not only has
someone been using our e-mail address but they have also hacked into our
ebay account and started selling goods that we don't even have, how long
have you been dealing with this guy and do you have any other e-mail
addresses for them other than this one? Did you send him any money =
because
if you have you may have lost it. We are talking to ebay trying to get =
our
proper user name back as it has been changed.=20

The proper David

Sorry if this has caused you any problems

Didn't you realise it was a scam as it was sold so cheap and shipping so
high

=20

With that information I cannot believe that the account was ever actually compromised in any way. If you review his past purchases as I have, you will notice that he has bought several Yamaha Raptor 660 items, which is what this shock fit. There was a T-shirt he bought, and he also sold some rims and tires. Why would an account hi-jacker sell something low dollar like a shock, and what is the chance of it being for the exact same bike that the seller had previous bought and sold items for? And even more oddly, why would a scammer send me an email after the auction has ended telling me the shock was broken and that he would not be able to sell it to me? He wouldn't, that would be the last thing he would do. Why would a scammer leave positive feedback for other auctions? It would be a waste of their time and resources better spent putting up new auctions and getting more money from people. The whole account takeover thing is all a bunch of bullshit by him in an effort to get out of this and get a clean slate account to work with. Furthermore, there were no other auctions by this seller to end because I have had added to my favorite sellers for the past 2 weeks to watch anything he listed, and not a single thing has came through. And one other thing, if his account had been taken over, wouldn't the scammer have changed the primary email address to a seconday paypal account he could receive funds from? Yeah makes sense huh? Well he didn't, When I sent the paypal money it was sent to David Webb's paypal account using the same email address as in all of our contact. Not someone elses. I explained in several email's to "the scammer" that I would be sending paypal, and "the scammer" never once suggested me to use an alternate email address or service such as western union. Why would he have me send the payment to an account he could not access to receive the money from?

Regarding your inability to contact him, I requested his contact information on 3-19-05 and the following is what I received:

User ID: lsalamalecu
Name: david webb
Company:
City: redditch
State: Worcestershire
Country: United Kingdom
Phone:
Registered Since: Tuesday, Jul 29, 2003 12:18:57 PST

I find it insulting that even with all the information I have presented proving that his account WAS NOT taken over that ebay is still pushing this idea as what happened. I suggest in the future you try and atleast read and understand the concerns of BOTH sides, and not be over biased to the seller because you will still get your fee for auction from them one way or another. Please reply, and explain to me, point by point, on everything I have mentioned how it can concur with the sellers account being compromised and then I will be happy.

Disgruntled ebayer.

OK, thats my letter back to ebay. Now heres what I got from them this morning:

Hello,

Thank you for your email. I can confirm that the item you were bidding
on was not listed by the owner of this account and as such they are not
held liable for them.

Please note that we have recently ended all listings for the seller
noted <<vodkamonster31>> due to our inability to confirm the seller's
contact information and/or their inability to deliver the merchandise
advertised on our site. The seller's privileges to trade on eBay have
been temporarily suspended while we investigate this matter further. Our
records indicate that you were a participating bidder in the seller's
listings.

Under these circumstances, you may want to reconsider how you complete
the transaction. If you have not sent payment for this item, we strongly
recommend that you do not do so. If you have already sent payment, we
advise you to take steps to protect yourself depending on the nature of
your payment. For example, if you paid by personal check, you may stop
payment on the check. If you paid for this item with a credit card, you
should contact your credit card company's security department right away
to inform them of the potential problem with this payment -- most
companies provide full protection from loss for online purchases in
these circumstances. If you have made a payment by money order, you may
contact that company for further information at 1-800-325-6000 (Western
Union), or at 1-800-926-9400 (Money Gram).

We emphasize that there is no definitive information regarding the
seller or their items at this time, and our difficulties in confirming
information about the seller may be the result of a mistake or
misunderstanding. We will notify you as soon as possible should we learn
more information that would make it safe for you to complete the
transaction.

Having spoken to the seller myself I can confirm that he refunded money
to a member (he was not aware who) regarding an item he did not list.

There are many tips on how to protect yourself with any Internet
transaction on our help page located at:
http://pages.ebay.com/help//confidence/payment-tips.html

Kind regards,

John Murphy

If he is really in the UK, then why did he:
#1 list that the shock is set up for 180-200lb rider? Over there they measure weight in kg, not lb.
#2 give the shipping price within the US? If he lives in England? Sounds fishy.

Yer best bet is to just sabotage his other auctions with a phony account, and make him regret being an a-hole.

I'm not sure on #1...because I know they dont use kilometers, they do use miles to measure distance. Maybe weight is different, I'm not sure.

I would guess because he knew the majority of the interest would be from the US. Probably not that big a of a market for that kind of stuff in the UK, but I could be wrong.

Billy, Did you think about contacting the company he said rebuilt it and see if they can confirm he had it rebuilt? If they confirm the same guys info then that gives you a little more info to send to ebay to show them he did welch out on the auction.

I don't think that any country calling their money "pounds" uses the metric system?

Its funny, I almost get the impression that all Ebay wants to do is bring you a seller and take your money and not back you up when there is a problem. (Greedy) A little off topic.
