View Full Version : Attorneys and Law experts: Question on a general appeal process

So it looks like my MX track has a possibility of being taken to a circuit court for appeal. I'm googling for information without much luck, but what I want to know is the general process of an appeal. Who files what, What exactly is taken into account from previous rulings, how important is a verbatim record, ect. I think I'm gonna be sick...I was this freakin close and now I'm gonna probably watch it all swirl down the drain. :(

have you talked to any local attorney's? or talk to there secretaries and ask for some written information that can be copied so you can take it home and read it. thats one way i would go. or go to the court house and ask who ever runs that hall of records and see if there has been anything similiar to what you have done and are getting ready to go through.

No, I haven't talked to any local attorneys because I'm not confident of my confidentiality with any of them. This is an extremely close knit small town and a couple of the people I'm worried about are "big wigs" in the area that have pull and are owed favors by everyone. If infact an appeal is filed then I plan on contacting someone from out of the area.
I hadn't thought of the county record vault but I might do some research into it.

Damn billy, you cant get a break. People like that are the kind that will never give up, they are relentless bastards on a mission to make everyone else as miserable as they are. THey cant stop you from riding on your land, track or no track, so if they overturn all you work, Lets have a party right on the fence line next to the nearest house! they will beg for the track hahahaha

Hey will, I just wanted to tell you I did get the pictures of the pipes and I do want them for sure. Its just with the pending possibility of a legal battle i cant put a price on them right now. Maybe when we get setup to do the trade for the SX (Hopefully this month) I can bring some cash with me and we can do it then.

I'm no legal expert and can't help you there, but what I can say is that people in power seem to like to intimidate and push others around. Those who persevere, don't back down, and fight like mad 'till the end are the ones that usually triumph. Don't give up man, don't get discouraged. Anyone that has ever tried to open a ride area has faced the same challenges. Most people hate ATVs and don't want it going on around them. Contact an attorney that's outside of your region. Lawyers are a pain in the ass to deal with but there are some out there that will talk to you without trying to bleed you dry.
Another thing you might try- some guys in my area managed to turn a rogue riding area, that was in danger of being shut down, into an organized, legal, legit ride area. Go to www.towercitytrailriders.org. Contact John Grodensky. See if he can help.

Does Florida have an abate chapter? I know in Indiana they will help you find the right lawyer for your situation.
