still won't hold up in court. a bill of sale is BS without a title. It's sorta of a good faith agreement. My buddys trike was taken by the fuzz. he came in with a bill of sale and was told " Sorry thats nice but thats not legal" Without a legal title he could not get the bike back. But it could be diffrent in your state

Thanks Eric. Levi, I'm more worried about them messing the machine up and coming back to me and asking for their cash back. I'm straight up with them about the machine at the time of the sale, but there are people that will try it. This is just to try to protect me.

another thought on selling a trike, if a person wants to test ride it, especially if it doesnt have a title and can be confiscated if the rider is riding in a residential area. Tell the buyer, pay for the trike and give a bill of sale. if the guy doesnt like it on the test ride you give a full refund. If the guy that wants it happens to get pulled over, and the trike gets impounded, its his trike and he deals with it, if the guy does something dumb and hits it, or hurts himself, its his trike, not your problem. jim

Let's just say the laws are much different in Alabama than they are in NJ.

There aren't too many if any 3-wheelers floating around here with titles anyway.

Around here, hardly anyone bothers to get even a car/truck Bill Of Sale notarized. It's just not that big of a deal.

In PA you need to have the title notarized when it is signed. I bought a car in PA but all the way out by Ohio. When I went to the DMV in NY to register it they informed me that I couldn't register the car without the title being notarized. Luckily I worked at a dealer and the lady that was a notary was way cool and stamped it for me even though it was supposed to be signed by the seller in front of her.

You might want to check the spelling on that bill of sale if you intend to use it. I know for a fact that guarntee is spelled guarantee and merchandice is merchandise. Honestly, I don't think there's any reason to have that whole line about received in good condition, the state doesn't give a crap about the condition its in and if you buy something that's not in good condition then you'll have to change it. I'd also add lines for the buyer and seller to print there names and addresses.

As for a bill of sale having no legal meaning, if you get caught by the cops riding a machine that was stolen at some point then that paper is proof of who you bought it from. It might keep you from having the theft charges pinned on you. Also, at least in NY, if you have an ATV (or PWC or maybe even a dirt bike) that you have no papers for, you can bring a digital picture of the VIN along with a bill of sale and a DMV form filled out by the previous owner and get a non-transferable registration. Then when you renew the registration after a year the next one will be transferable so you can sign the back of the registration to transfer ownership to someone else. I've done this with both my 350X and my Polaris PWC.

Thanks for the spell check John. I'll change that. In Indiana you don't have to have a title notorized anymore unless its an old one. As far as trikes and dirt bikes go, when I bought my son a new 04 crf150f, there was no title for it , so I don't know what size bike they start giving titles for. As for the " in good condition " line, you make a good point.

For whatever its worth, I've gotten trikes titled down here with nothing more than a scratch piece of paper with the 2 names, the vin #, the price, and what the make model year of the machine was. Nothing else.

It also might help to have the names of both party's printed, in addition to being signed. Then there's no doubt who it is.

In NJ, a bill of sale is a worthless piece of paper w/o being notarized. The MSO(its not a title), is pretty worthless also. If anything, the MSO brings more questions and things for Dmv to shoot you down on. With that piece of paper, you need notarized bills of sale to track it from the original buyer(on the mso) to the person you bought it from. I registered one quad, it was bought from the original owner, they didn't want to see the mso, they wanted a notarized Bill of sale and questioned about the lein being on the mso(another place the mso can get you in trouble). I tried at one point to have my atv's registered, I had to jump through hoops to do so, I just gave up. I wanted to get a title to the frame that hre made, I was given several things to do and details about it. Next time, I'm there, I'm gonna try and get a bill and details. The state wants to know everything about the bike and cost of it, 90% it was bought piece by piece and then they will try and get me with tax on all this stuff, that is if the state accepts it. Same goes for my 250r hybrid, but in this case, I don't talk to the guy I bought it from, so I gotta lie and hope I don't get caught.

If you buy something in NY and you have the original MSO. You are the owner and there is no question. I have worked at a dealer almost ten years. Recently named the #1 yamaha dealer in the country. Unless you register that unit in your name, then the MSO goes away to the DMV for good. Bye bye you never see it again. Then you need the title/registration and bill of sale notorized.

To register your trike here in MN all you need is the vin# and $53.50 (3 year tag)

Unless what I'm reading on the DMV's web-site is wrong, the bill of sale does not need to be notarized. I registered a PWC that the previous owner had lost the paperwork for without a problem. You just fill out the form I linked to below along with the other stuff they have listed in the form and you're good to go.

Good link John, That is the form I use with the DTF-82, and Bill of Sale. It only cost 12.50 a year in NY, a lot better than Fines and Court surcharges! We register all of our keepers that are being ridden and insure any that we use off of our property. I just bring in the penciled VIN and a dated photo for a back up and never had a problem. Our Transferable Registration is just like a Title in NY and makes it a lot easier on the buyer if you decide to sell!
