Well I'd want him on my side if someone stole my intellectual property, trademark, or logo and profited from it.
Why do you think you register your invention with the U.S. Patent Office, and/or register your trademark or logo with state and federal agencies. Disney and Microsoft employ legions of these guys.
Don't get me wrong I don't like layers either.

I'd hate to say it but if it's copyrighted he's right. The author sold his story to the paper and the paper owns it. Plain and simple. I know it stinks but all the bloggers have to do is give a link to the story. It's not right that someone did the work and another uses it for themselves as it was their own. Kinda like when your at work and doing your job and some trailprotrailprotrailprotrailprotrailprotrailprotr ailpro takes credit for doing your work and getting a promotion for it. You'd be btchin' and want to sue too. These laws have been in place for many of years but you'd think the bloggers would know...oh wait how could they when they don't do the work or research on 99% of what they write.

You can post links. As an example, I'm a member of a Phoenix Suns forum. Some of the posters there will copy and paste news articles related to the team (along with a link to the site they got it from usually). That's the kind of stuff this guy is going after. You can't copy and paste the article in it's entirety and it's true, that is infringement.
Where the douchebag part comes in, is this guy is going after site owners regardless of wether or not they are the ones that posted the article. If a member posted it, the law says you're supposed to send a notice telling the operator to remove it (cease and desist order). This guy isn't doing that. He's jumping straight to lawsuit knowing most people cannot afford to defend themselves and just collecting settlements.

It is perfectly fine for you to use copyrighted material as long as you source it. However, if you use someone else's copyrighted material for monetary gain without consented approval, then you are in fact using it illegally.
If a business owner plays music in the background of his store, and does not have a subscription, he/she can be sued. Typically you have to pay fees to ASCAP. Even though the business owner is not using the background music to monetarily gain, it is the law.
Yeah, this lawyer is a tool, but he found a way to make some big $$$$$$!!!!

Id understand using the article to progress yourself or for personal gains...other than your EGO. Suing bloggers? come on...that's like suing the lunch table gossipers......
