View Full Version : i got a ebay case opened against me. wtf

this is the first time someone filed a cliam against me. just wanted some advice. but i know i'm in the right.
i sold a yz250 crankshaft to a guy in portugal. i shipped it on oct 29th. i have proof of shipping and when it left the country. how can i control the shipping over there? its probably stuck in customs somewhere. he wants a full refund plus shipping because it hasn't gotten to him yet. thats bullshit.
so i should be good if i put the tracking info on the ebay case. i don't see how ebay could be on his side when i have proof i shipped it.
i've shipped to spain before with no problems. maybe i shouldn't ship overseas anymore. its more of a pain anyways. and i know once the package leaves the country its out of the post offices hands, so ive been told. and if it is lost, i put a low value on it because he didn't want to pay custom fees.

I believe... if you have your shipping information and tracking numbers all in order, there is nothing else you can be responsible for. You did your job, mailed it per his address etc etc, what happens with the post office (even within the US) can't be your problem. Key words are shipping information and tracking numbers. If you messed up in those at all, you might be SOL. Was it paid via PayPal? Was his address and everything "verified"? If so... it might have to have a Post Office case opened against it as lost mail.

i sent it priority international. there tracking isn't the greatest. but it does say when i dropped it off and when it left the country.
i was paid with paypal. sent it to his ebay addy. which was the same as his paypal. most addys from overseas aren't verified.
he wanted it sent as a gift and the value of $10. saves him on custom fees. so if it is lost i'd only get $10!

oooo eeeek.... the gift shipment... yeah that sux. Can the P.O. track it at all? You would think there has to be SOME sort of tracking available.....

I had this happen once. eBay took my info. Looked into it and judged for me. Then when it arrived he said sorry but eBay only gives you x amount of time to file otherwise you can't. He might actually be OK just worried if he doesn't file now, he can't in the future. eBay must fix this for overseas transport. The 30 days is not long enough when you factor in customs, they can take a long time.

Welcome to the wonderful world of Ebay, seriously tho. We used to do $10,000 a month business on Ebay. At one time they had a working system till they started messing with every aspect imaginable, now we are lucky if we do $2000 a month. With their new rules you have to show proof of DELIVERY even then if they want a refund they will most likely give it to them.
I have had more than one item held in customs, customer gets a refund then it shows up delivered.... Guess what they now get the item for free because ebay already refunded it. To make matters worse most of these A-Holes will leave you negative feedback. I could go on but I'm in a pretty good mood and don't want to get all pissed off for the day LOL. At any rate try not to take it personally, ebay screws all sellers!

If the tracking number is good you should be fine. Stop in your local post office. They usually can look up the number and get actual progress of the tracking. Online they are very limited on the info they give.
It sucks about the gift thing though. I usually put it as a gift but value it as $100 just so I don't get screwed.

I dont sell overseas anymore and it sounds like you may not in the future either. Takes one burning to learn.....

I had a similar thing happen not long ago. I sent a email to ebay and they removed the case from my file.

did you email them while the claim was active, or after they refunded there money? cause it looks like hes gonna win no matter what i do. just from what i was reading.
and if it does get delivered eventually, will i get my money back? can i appeal the ruling?
never really looked into it, but it looks like the seller has no rights! why would i want to sell on ebay?

this is EXACTLY why i don`t sell on Ebay anymore...the seller has no rights especially after they did away with the seller being able to leave bad feedback
I had 100% feedback on 90 transactions....sold an item on ebay for a friend....he went to package the item 2 hours after auction ended and damaged it in the process...it went from perfect to having a tear in the upholstery about a 1/4 inch long...three hours after auction end, I immediately refunded his paypal payment in full BEFORE I sent him an email describing what happened to the product...He emails me back saying he wanted the product anyway at a much discounted price...I explained that I could not force my friend to accept a price he didn`t want to accept damage or not and that i would NOT be relisting as I can`t count on my buddy not to damage his stuff after it sells....All I ever wanted to do was be a fair seller and I felt like I SHOULD IMMEDIATELY REFUND his money since the item was no longer perfect and perfect was what he bid on, not damaged...since it was now damaged he DESERVED an immediate refund and my buddy deserved a kick in the shin...I did what I thought was the honorable thing to do (immediate refund)and I got burned
Buyer emails me back demanding the part again (still not bothering to resend the payment and he still has his money back and I got stuck with a bunch of fees thanks to this crap.........................24 hours after auction end buyer emails me again saying "I noticed you have 100% feedback and I know that you worked hard to maintain this. It would be a shame if you got a negative from me because you won`t sell me the seat anyway for XXX (major discounted) dollars"
I emailed again to warn that extorting a seller with feedback is against the rules per Ebay policy (which it is a major infraction that can get one`s account suspended)...he responded by saying if i didn`t sell him the seat at the discount rate, he would be forced to leave bad feedback and "ruin your score"
I promptly forwarded his emails to Ebay Conflict resolution whereupon they told me three days after he did indeed leave me a negative score calling me a "ripoff artist, scammer" in the comments (even though he had his money back since two hours after auction end and a week and a half before the bad feedback) they said there was nothing they could do other than ME ask the buyer if he would agree to mutually remove the bad feedback or I should send him the item anyway money or not!!!
Since you cannot mutually remove ANYTHING when you are the seller and cannot leave bad feedback anyway, what the heck is the difference?
So it took me a year to get 100% again and when you only have a 90 something score and maybe 12 transactions a year, one negative drops you to like 89%
they didn`t seem interested at all in suspending him for trying to extort me with my feedback score and I guess in the end, if I didn`t have an ounce of moral fibre, I would`ve just sent the damaged seat and kept all his money...but I don`t roll like that
Ebay finally called me on the phone to "see if the problem was resolved" to which I replied my score was screwed and I would no longer EVER sell another item on Ebay...as this was the second problem I had selling an item....I posted a trashed 200S for sale as a parts trike in Parts and Accesories and it sold...problem was, they relisted it in the Powersports category without my knowledge and the difference was Parts and Accesories was a $4.95 listing....Powersports for an ATV is $4.95 + $100 dollars flat for the listing on a trike I sold for $200...they told me they reserve the right to remove or relist items in other categories as the person on the phone implied I was trying to sell a working, running ATV as parts & accesories to get out of paying for the Powersports listing...sure it ran...barely and it needed multiple things replaced because it hardly moved wether the motor ran or not
Ebay and the scammer buyer can both kiss my arse....I no longer sell anything there
