WTF happened :crazy:
So Garcia Zarate finds a gun that was stolen four days prior from a Federal agent and the jury couldn't even find him guilty of negligent homicide? I feel badly for the family that was robbed of their daughter and now justice for her murder.
I am amazed that the jury couldn't arrive at guilty for negligent homicide when they agreed he was guilty of negligent discharge of a firearm.
Sounds like his two years awaiting trial could satisfy time served for the gun felony charge of 2 to 5

Elected officials that promote sanctuary cities should be held liable in a class action suit created by families of victims all across this country.
Maybe a group of lawyers can initiate a class action civil suit vs all the current mayors and governors that believe their job requires harboring illegals living in their jurisdiction.
Suing these 'leaders' for an enormous amount of $$ might make other politicians think twice. Only reason this man continued to come back to SF was because he knew he could get away with it since he was doing it for years without real consequences for breaking our laws

The concept of a sanctuary city blows my mind. What possible motivation exists that justifies harboring known criminals???
Many of the Mexicans I know think it makes perfect sense to expect America to allow illegals to stay, but think it’s also fine for me and others to jump through the Mexican immigration hoops, pay taxes like everyone else and be penalized to the tune of an extra 30% if I sell a property here because I’m not Mexican. Try sneaking into Mexico illegally and see how you’re treated.

It runs a tad deeper than the above mentioned items...... kate was used as an example of failed immirgration policies in california by Donald Trump during the election cycle when he was campagianing. He brought her name up often. And for good reason.
Now the liberal stronghold of San Francisco and its jury pool to pic from has given Trump, and Kates family and all who voted for Trump, the middle finger. Justice means nothing to the Liberals, they just want revenge. No morals at all.

I heard on the news this morning something interesting. It's in the language. The term "Sanctuary City" is so very misleading. I will refuse to call them that, but rather use the normal term "Outlaw City".

Speaking of division.... If I understand correctly the proposed tax changes that trumps administration is trying to put through which limit, or eliminate State tax deductions will pretty much drive the middle class out of the blue states and bankrupt them.
I’m no expert on this, but I thought that the original intent of the constitution was to leave power in the hands of the state and limit that of the federal government. The federal government grabbing up tax dollars before the state gets their hands on seems to be the opposite of that, I always thought federal domination was more of a Democrat goal than Republican, but at this point on history I can’t help but wonder if this isn’t a bit of orange revenge.
Interesting times ahead.

THAT might actually get the attention of the career politicians, but more likely the left and the media would label you hate mongering supremisists using your white privalage power to disrupt the lives of the downtrodden and disparaged.

If any of you think that justice is doled out in the courts on a regular basis you are sadly misinformed. Next time you have a day off, head down and spend a few hours in the benches. Watch the machine eat. If you haven't already, id encourage you to read Bonfire of The Vanities. The description of the justice system in that book, although not really a main theme of the story, i think is spot on. “You couldn’t see inside the vans, because their windows were covered by a heavy wire mesh. It's now a sanctuary STATE, not just a city. He picked up a gun, pointed it in the direction of people and pulled the trigger and the bullet hit someone and killed them. 5 time deported felon and obviously a danger to the public, and they found him NOT guilty on all counts. This state is completely nuts and backwards and getting worse every day.

The story you are recalling is a mix of 2 that I have shared here actually. I grabbed an armed sheriff by the collar after he grabbed my best friend, and I berated and shook the piss out of him while his supervising officer stood by doing nothing, which I pointed out repeatedly during the outrage. The second story, is a long one, however ends in me taking a knife from a marine squad leader.
I will appreciate it if you tell your own stories, so as not to defame or slander me any further.

Actually I was wrong, I didn't know that scooter would minimize a traumatic and violent event that happened to an acquaintance he's been communicating with for around 4 years.

Multiple people in this thread I am in contact with regularly through phone calls, text, and meeting in person. I live alone, I don't go on the book, I don't go out much. People come by all the time but life has changed drastically. As anyone who really knows me knows, I cut people off. It happens a lot to a lot of people I know. I hide because human beings make me sick, and that could very well be my problem, but it is what it is.

We are different which sounds so cliche, but it really is the truth. Even if we butt heads at times. We argue, we solve the world's problems and sometimes create others, but if you're having thoughts of violence and laughing about it, that's your choice. Or if you're laughing about someone else physically acting out in violence against someone you know, you're desensitized to me. Nico you're a funny guy, but not everything is a joke to me. I've been riding Harleys for 30+ years, hanging out in the vicinity of large gatherings of bikers including, but not limited to, members of 1%er OMCs, along with various "bottom of the barrel" dregs that the lifestyle attracts. My problem with the trial was that the suspect's legal status was kept from the jurors. Why would an illegal who has been caught in America five times previously be afforded the same rights as an American citizen?
To me the fact Zarate was an illegal should have been disclosed to the jury since this fact should be weighed in determining his guilt. Hiding the fact this man is not American, but a foreigner with a previous criminal record is not justice.

Fabs, I do not have time at the moment to comment on all of what you wrote, but I’d like to make two points before I get on with my day.
I’ve met and worked with a number of stabbing victims and one shooting victim. Aside from violent wounds they all had one thing in common, the were all azzholes of the highest order. Based on Damon’s Internet demeanor it isn’t a hard stretch imagine him escalating a situation rather than trying to defuse it. Furthermore he informed us of it in a flippant manner as he did the passing of the innocent victim that the post was about. Remember the law of attraction? I suspect Damon’s cut was a result of it.
Secondly, some of us enjoy hunting. Hunting as I know it is not an act of violence. It is the continuation of tradition that made it possible for our species to get to the top of the food chain and it a great way to enjoy the outdoors and bond with friends and family. Hunting has always been part of our social structure. We don’t have to do it anymore in order to eat, but not that’s a decision personal choice and not one a politician or tree hugger should made.
John, i can cite everything I said about the dude, except for the fact that he would care if she was friend or family. Everything you said about me is assumed incorrectly. Dont believe me? Look up the George Zimmerman/Treyvon Martin thread, i argued that Zimmerman should have went to jail because I don't care what color the victim is. Now, i believe after the verdict, i changed my opinion because of the new information I read. The news outlets told that they got into a scuffle that George started, and it ended with Treyvon being murdered. That wasn't what happened, and that wasn't what was argued in court. Treyvon made it home after the scuffle, then went back out to find and confront George. That's why it wasn't murder.
There are a few things the iritated me about this case. The first was the loss of life. I don't care what color or religion anyone is, the loss of life upsets me. Hearing about a woman die in front of her family is upsetting to me, i don't understand how it could not be upsetting to you, the dude, or anyone else. Second, this was preventable if common sense laws were upheld. No new laws need to be put in place here, the existing ones would have prevented this tragedy if they were followed. And third, the murderer wasn't held accountable for his actions. I don't understand how this isn't upsetting to everyone. Maybe I care too much, Idk. The day before Thanksgiving a woman was walking her dog here in western NY, and was shot by a hunter who mistook her for a deer. It was after legal sunset and she died. Does this upset you Dude? John? Because it sure upsets me. It's a terrible situation for everyone involved, but i hope the hunter is held accountable for his action because he was wrong. Just like the OP. If you find a gun on, pick it up and it goes of you should be held responsible. Assuming the defense's argument was true. Its common sense to me.
And about the stabbing stuff, Nico never said he should be stabbed or wants him stabbed. Just that he could understand from years of watching dude troll people for the sake of attention, he could see how someone would stab him. Take the emotion out of it, it's logical.

The plain and simple facts of the matter are that our government is charged by the Constitution to maintain our borders. We have some local and state governments that are not only negligent in allowing the feds to do that job, but in open defiance of our immigration laws and actually putting out welcome mats for these people. I haven't the slightest objection to the orderly and lawful immigration of people who want to come here for the right reasons and become contributing citizens. I welcome them warmly. But for a criminal who was deported 5 times with little or no consequence to kill a US citizen and then walk for it is beyond atrocious when you consider the stances taken by these hack leftists who only want them here because they see then as an eventual electorate to Garner votes from. Its rotten to the core!

As to your stance on hunting, I took no offence whatsoever. I understand we are not all the same and you are just as free to refrain from such activities as I am to engage in them.

I liked your post John, you were thoughtful as always. I didn't explain my self correctly, as always. The Muslim example was used as a way to show Dude's contrarian nature. I think it is wrong to stand up for someone for the sole reason that they are Muslim. I had a very good friend in college who is a Muslim. We drank, partied, etc. I would stand up for him as a friend and as a good person. I wouldn't blindly stand up for anyone I don't know just because they are a Muslim. I'm just not that good with explaining things, its another reason I didn't become a teacher.

Dude has been "deported" what, 4 or 5 or more times? Only to "sneak back across the border", play nice for awhile, then reveal himself and try to convince others he's a changed man. Well said Sir. I love a good debate and sharing opinions, but lately it seems that if one disagrees with the convictions of others it jumps straight to insults. Yes, guilty as charged, but I’d like to think I’m not the one throwing the first stone in most cases.
Along with this there seems to be some folks on here with very thin skin who are more than eager to start or inject themselves into a controversial topic, but as soon as differing opinion is put up that contradicts their’s it’s a problem. They can dish it out by the shovel, but they start to choke and gag when they get a spoonful back.
I would think the Forum title of “OPEN” would be sufficient warning in itself that when someone posts up their thoughts here, no matter how deep or shallow they are exposing them to the masses for interpretation, interaction and perhaps even ridicule.
If they simply want to post their thoughts on a topic and call it a day, they can start a thread, put their post up and close the thread. Or they can not close the thread and accept that regardless of how convinced they are of their opinion that there will always be someone else with a different one and that that persons convictions on the subject may be equal or greater than there own.
When one enters into a debate they must first acsept that at some point they may have to be able to agree to disagree with the other side. Inability to do so is what leads to everything from dissolved friendships to wars.

It's now a sanctuary STATE, not just a city. And that's just it, I'm no BAR certified attorney but I believe the charge of manslaughter certainly applies here. You can be charged with that crime when you accidentally cause the death of another human being through your own negligence. The fact that he is a 5-time deported illegal and in a state where the politicians are in open defiance of immigration laws allowing pukes like this to stay makes it that much worse. Too bad the mayor in San Fran and the governor are not brought up on charges as an accessory in that crime!

I'm always surprised and impressed with the intellect of the members here (including Damon). Its also a great cross-section of society. People form all over. Each one fighting their own battle. Brought together by this one weird, quirky, AWESOME commonality. The word "diversity" gets tossed around all the time. This site is truly a diverse group. There is a case here in Massachusetts where a disabled man drove into the front of a restaurant and killed a couple of innocent people. He has a condition where he is slowly losing the ability to use his legs. Its not ALS, but its similar. Anyway, here is a guy who has grown to adulthood without a run in with the law. He gets this horrible disease through no fault of his own, and yet he still tries to maintain his independence. Well, the worst happened and people were killed. Its bad. They charge the guy with motor vehicle homicide. He's gonna go to jail. A decent person, who is dealt a bad hand, is going to jail. I can't help but wonder what would have happened to him if he was an illegal immigrant.

The way that US law varies from state to state is very interesting to me as compared to Canadian law which for the most part falls under federal (RCMP) jurisdiction as soon as it’s even remotely important.
So back in 2008 I’m spending a lot of time in Houston with some locals and a case comes up where a guy saw two people robbing his neighbors home, called 911 and told them to hurry up and come get these guys because if they step foot on his property he was going to shoot them. The 911 operator kept telling him to go back in his house and wait, but he kept repeating that if they come into his yard he’s going to shoot them.
Sure enough these two boys start walking towards the old man and you can hear him loud and clear on the telephone telling them to stop, turn around and get off his property or he will shoot them. A few seconds later you hear the gunshots.
He put them both in bed with two shots. No charges were ever filed even though a certain sector of the community which these criminals were from was upset over it, common sense prevailed. I love Texas. The don’t put up with any crap. Friendliest petiole you’ll ever meet if you behave like a visitor and the most bad ass cowboys around when someone tries to harm another person.

There is no mention in the link you posted that he has "never had a "run in with the law." or that he crashed because his disease made it impossible for his legs to operate the pedals, although I'm confident there is more to the story than what is written in this link, however, if in fact his condition was the cause, and he was fully aware that he could have an episode at any time that would prohibit him from operating a vehicle safely, he then in fact willfully and intentionally endangered himself and peoples lives and should rot in jail for quite a while.
Also, if he was fully aware that he could have an episode at any time that would prohibit him from operating a vehicle safely, he in fact is NOT a decent person, but is careless, reckless, and selfish, with little, to no regard, for the safety of others etc.
In addition, if his doctor had determined that it was unsafe for him to operate a vehicle, he should have notified the department of motor vehicles whom should have addressed the situation. f his doctor determined it was unsafe for him to drive but he did not notify the department of motor vehicles, he is also partially liable. If he did notify the dmv and they took no action, they are partially responsible.
As far as maintaining his independence and possibly not wanting to be a burden to others by having them drive him around etc, if his condition affected his legs but not affect his arms in any way, he could simply have had his vehicle outfitted with hand controls just like thousands of other disabled people have. Obviously not everyone has the money to have this done, however, being poor is not a valid excuse to endanger the lives of others and possibly kill some of them.

The judges are as biased as ever and are SPECIFICALLY chosen by their respective political handlers and voters alike as such and specifically for their personal political biases.....hence the whole Dem/Repub throwdown over who gets to nominate a SCJ for the past several years. These few years (decades) has seen numerous cases of the personal political bias of judges used to exert rule of law on political opponents for political reasons much like the IRS was busted for doing during the Kenyan administration. As a nearly 20 year CDL-A holder, I can tell you a few things about truck drivers and how easily something that was not the truck driver's fault becomes the truck driver's fault. Any time a commercial vehicle is involved in a fatal accident, that truck is impounded and treated as evidence and then gone over with a very fine toothed comb checking all of the major systems on the truck for anything wrong. Things like brake adjustments, brake component condition, brake component absence, suspension components, and on and on. Along with those things, the driver's log book is investigated several days back in time before the accident. Also, the driver is required by law to be drug and alcohol tested immediately after the accident. If ANY of these things show that the truck should not have been in that spot at that time to be involved in the accident in the first place, be it mechanical violations, log book violations, or the driver tested positive for drugs or alcohol, the whole thing is pinned on the driver. The way they look at it is even if a drunk ran a red light and went under the trailer, that truck should never have been there in the first place.
The way many of us see it, is that guy should not have been in this country to "accidentally" discharge that weapon in the first place. And beyond that, in Cali I'm sure it is illegal for a non-licensed individual to posses a handgun, besides the fact that in general, non-citizens are not permitted to posses a firearm of any kind unless that person has navigated the red tape to use a firearm in a guided hunt or other such legitimate purpose. So besides the fact he shouldn't have been here in the first place, he by his own actions committed a crime that any one of the rest of us would have been charged with and most likely convicted of.
As to the agent who "lost" his sidearm?? I'm sure he is dealing with some pretty serious repercussions (as he should IMHO) but I admit I have not dug into that aspect of this topic.
And one more thing: firearms in proper mechanical condition do not "accidentally go off"... I seriously doubt that agent's weapon was mechanically compromised

I disagree Damon. Yes, the rightful "owner" bears a level of responsibility for losing his weapon. And being that CA is just as strict if not more so than my home state of NY when it comes to firearms, I' pretty confident something is happening on that front.
However, let's forget that Garcia was here illegally for a second. He, by his own actions, picked up a firearm he was prohibited from even touching at that point, placed his finger on the trigger and pulled. You accounting of your own accidental discharge of a weapon indicates a clear violation of one of several rules in firearms handling that should never be taken for granted. And that is to keep your finger off the trigger until you are ready and committed to destroy something. You do not have to understand the English language to know this, so in this sense his immigration status is moot. There are other ways he could have handled finding that weapon laying on the ground, all would have been better than picking it up and pulling the trigger causing the death of that woman. That action alone is negligent homicide or manslaughter and neither have a thing to do with his immigration status. His immigration status coupled with the categorical defiance of immigration law by these "sanctuary-fill-in-the-blank" and their elected leaders adds insult to the injury because frankly, he never should have been here to commit the crime. I would expect any other citizen to be charged, tried, and hopefully convicted for this act. The case that Joe S referenced that just occurred this past Thanksgiving Eve involving a deer hunter shooting well after legal shooting hours killing a woman who was walking her dogs 200 yards away. He has formally been charged with manslaughter and rightfully faces 5-15 years. It all comes back to the personal responsibility when handling a firearm.

I don't disagree with you on most of that Damon and I don't take it that you are excusing the action. But I don't think it made headlines simply because brown killed white. It made headlines because it is 5-time deported illegal kills citizen. That is the hot politics of it and why it made headlines IMHO for the reason that he shouldn't have been here in the first place. I don't believe there is or should be any extra penalty for the charge due to his status, I guess I'm just trying to say it makes the whole thing that much more of a tragedy because the failure of one system (Immigration) was the first domino in the chain of events that resulted in the loss of innocent life and IMHO the gross failure of another system. (the justice system). And further tragedy is the fairly obvious miscarriage of justice because of politics and not rule of law

Sled, things are kept from the jury ALL THE TIME. Its an abomination. Its a tool lawyers use to control the outcome of cases. They pick and choose facts and its, IMO, unconstitutional. (although its everyday practice) The idea is that this fact or that fact would somehow "bias" the jury. Facts are facts! How can a FACT bias anyone? Judges and Lawyers want control in the courts, but they profess that Jurors are the backbone and all that BS. In reality, Jurors are rarely used, and when they are, they don't get all the information. You see, these same judges and lawyers don't trust the sense of the regular joe to make the "right" decision, so they manipulate the facts given to them. Then, when the Not Guilty comes down, people point fingers at the Jury. Its mind boggling. Are you guys familiar with the Aaron Hernandez murder case??? You know, the guy that used to play for that greatest football team in the history of the world? Ya, him. What a story that is. Gay sex, drugs, and multiple murders. Oh my! But what you guys probably don't know, because it was downplayed so much to hide the gay sex aspect, is that Oden Lloyd, the third murder victim, sent a text to his family on the night he was killed, because he knew he was gonna get killed. He texted to his family something like, "If anything happened to me, I'm with NFL, just so you know." That statement,,,, essentially the last words of a dying man, was not allowed into evidence at the trial! Take a second to let that sink in. The murder victim leaves a message about his killer, and its left out because it might prejudice the jury against the defendant. ISN"T THAT THE PURPOSE OF EVIDENCE???? Yes, intent should be considered so it often is, however, one obvious problem is that a person committing a crime etc, is often, if not always, the only one that truly knows what their intent was unless possibly they are insane. Intent is one factor that attorneys use to determine the charges against people. I'm reasonably certain that the guy that turned the restaurant into a drive thru had no "willful" intent to do so but that does not mean that he was not intentionally negligent. It's certainly not as if his brakes simply failed through no fault of his own because of a defective part, in which case, the part mfg could be held liable under some circumstances. I, and I'm sure many others here including yourself are aware of cases where mfgs have been sued due to injuries sustained because of a faulty part. Most everyone is aware of the flaming Ford Pinto law suit as one example. When I worked at Kawasaki we were in the initial stages of being sued by some police officers that crashed while pursuing someone on their police bike because they claimed it was unstable at high speeds.
I was part of the test team that had to test the bike to see if the claims were true, and we ultimately proved they were not, however, I did do some modifications to the bike that increased high speed stability which Kawi incorporated into the next years model. Then there was the eternal lawsuits over KH500, aka, "The Widow Maker.".
Anyway, intent was certainly a question the jury legally had to consider in the Steinle case, and since they couldn't prove the guy intentionally shot her or had any intent to shoot anyone, they certainly couldn't convict him of murder/homicide in any degree.
Someone here asked about charging the shooter in the Steinle case with involuntary manslaughter, and it was one option given to the jury by the Judge, however, by California's definition of that law, the shooters actions may not have met the necessary criteria to be charged with manslaughter as horrendous and repugnant as that may seem to some.

Yes, intent should be considered so it often is, however, one obvious problem is that a person committing a crime etc, is often, if not always, the only one that truly knows what their intent was unless possibly they are insane. Intent is one factor that attorneys use to determine the charges against people. I'm reasonably certain that the guy that turned the restaurant into a drive thru had no "willful" intent to do so but that does not mean that he was not intentionally negligent. It's certainly not as if his brakes simply failed through no fault of his own because of a defective part, in which case, the part mfg could be held liable under some circumstances. I, and I'm sure many others here including yourself are aware of cases where mfgs have been sued due to injuries sustained because of a faulty part. Most everyone is aware of the flaming Ford Pinto law suit as one example. When I worked at Kawasaki we were in the initial stages of being sued by some police officers that crashed while pursuing someone on their police bike because they claimed it was unstable at high speeds.
I was part of the test team that had to test the bike to see if the claims were true, and we ultimately proved they were not, however, I did do some modifications to the bike that increased high speed stability which Kawi incorporated into the next years model. Then there was the eternal lawsuits over KH500, aka, "The Widow Maker.".
Anyway, intent was certainly a question the jury legally had to consider in the Steinle case, and since they couldn't prove the guy intentionally shot her or had any intent to shoot anyone, they certainly couldn't convict him of murder/homicide in any degree.
Someone here asked about charging the shooter in the Steinle case with involuntary manslaughter, and it was one option given to the jury by the Judge, however, by California's definition of that law, the shooters actions may not have met the necessary criteria to be charged with manslaughter as horrendous and repugnant as that may seem to some.

ok, sure that makes sense, however, as everyone knows, there are many hours of testimony at a trial like this, so without actually being there the entire time, or having the complete transcripts including the judges instructions to the jury etc, it is just not possible for outsiders to know for certain why a jury voted one way or another. Obviously even with the same info, the jurors still don't always agree with each other which can end up in a hung jury/mistrial etc.

The term "accident" is the most misused term I can think of.
First off, running a red light and t-boning another car IS NOT AN ACCIDENT. It was caused by the driver being negligent in the VERY IMPORTANT task of SAFELY OPERATING A MOTOR VEHICLE. Being negligent negates the term "accident".
I mean ffs, how much warning do you need to figure out that a light is turning red?
Federal guidelines recommend yellow lights last from 3 to 6 seconds. Local authorities set the duration based on many factors including: traffic volume, speed, roadway grade and intersection design.
3 seconds appears to be at 30 mph, 6 seconds appears to be at 55 mph
Spare me the bullsh!t that yellows are too short. I've been driving plenty long enough to know that if you are going the speed limit there is plenty of time to stop on a yellow before it turns red, and I'm a guy who regulary runs yellows.
You all know I'm right. (Yes, I know there have been some cities caught shorting yellow times to generate ticket income, but that's a different thread.

Crashes are crashes. Not "accidents." Two vehicles colliding is a crash. A crash can, and often is, caused by accident. Accident meaning "without intention." Sometimes crashes are not accidents. The issue at hand isn't malice. It doesn't matter if the offender tried or didn't try to crash into (or shoot) anyone. The issue is whether or not a reasonable person knew or should have known that their actions presented an undue risk to others. This is true in crashes as well as shootings. At least it should be. Lets say I live in an apartment above another apartment. Lets say i'm cleaning my gun and I "accidentally" fire the gun into the apartment below and the bullet kills someone. That is an accident, but I am still responsible and will face consequences. The consequences should not be the same as if i set out to shoot someone and follow through by shooting them. The law allows for this by differentiating between degrees of murder as well as manslaughter and negligent homicide. It is also not the same as if I break into a car and fire a gun in public killing someone. Every situation is different, and there are degrees of evil. But the system is a huge failure. This case is a perfect example of how poorly it functions.

This I will strongly agree with. The system is a flop, a follie, just like a good portion of anything run by the United States government in modern times. It needs to be razed and completely re-thought.
If anyone is interested in seeing a system that works, study Finland's judicial system. Makes discussing our own judicial system seem pointless.

I think what Scooter is saying (and he is welcome to correct me if I am misinterpreting his comment) is that no matter how light or heavy the trigger pull is, a firearm in proper mechanical condition requires human manipulation to fire a round, a finger placed on the trigger and pressure applied. This is why the rules of firearm handling are so universally and deadly important. Unless a firearm that has been involved in an accident of some sort is indubitably found to be mechanically deficient or unsafe by at least one competent expert gunsmith, there is absolutely zero excuse for an AD no matter what the circumstances.

My wife's a director of a childcare, she runs peoples quaries all the time and its mostly 20-30 yr olds its just amazing how many of this generation has had some sort of run in with the law. Kinda scary actually.
There usually not small offences either, but they get upset when she can't hire them.
On a different note- i found out just recently that my wifes mom had my quarry (sp) ran when i started dating her daughter, just a little upset at that one but life goes on.

I don't know if this is what the Dude meant by "hair trigger", but revolvers have two very different trigger pulls depending on if you manually cock the gun or not.
Well, first of all he said in his post:

First off, there is no button, switch, lever, etc, to change a trigger to "hair trigger mode".
There are a few types of triggers, including triggers on semi-autos that do the same thing that you mentioned about revolvers, but to keep this relatively simple we'll cover the two mentioned by you and the the dude. Then we'll cover the "hair trigger" aspect.
In a revolver, you would be talking about a Double Action trigger. Double Action meaning it cocks and releases the hammer. The Double Action pistol can also be cocked with the thumb and the trigger will release the hammer. The term Double Action refers to revolvers, not semi-autos. You'll see why below.
In the dudes scenario
loaded and on hair trigger there will be some assumptions made, but only because I don't know the brand and model of pistol.
In order to be in so called "hair trigger mode" the pistol would have had to have been cocked.
The pistol would have had to be either a Single Action Only, or Double Action/ Single Action.
With the Single Action Only pistol, the hammer must be cocked by hand for the trigger to release it. The trigger will not cock the hammer, the action of the slide ejecting the spent case recocks the hammer. Think 1911 style pistols.
Double Action/Single Action means you can fire the pistol either way, by just pulling the trigger or by cocking the pistol first.
My 1911 from the factory had a trigger pull of about 7lbs
The Double Action/Single Action Beretta M9 has a double action first trigger pull of approx 13lbs and a 5lb single action trigger for the following shots.
Some "experts" recommend no less than approx 4 lb trigger pull for conceal carry. My 1911 after the trigger job was done is right around 4.25lbs, yes, a noticeable difference from stock, but still no where near a "hair trigger".
I have aquaintences with competition pistols that have trigger pulls in the 2lb area. Now we're talking "hair trigger".
If you shot my 1911 and then I handed you the competition pistol AND TOLD YOU IT HAD A HAIR TRIGGER you would still be extremely surprised at how little effort it took to squeeze the trigger.
So how does one achieve this "hair trigger" you ask? Well, depending on the gun, polishing the hammer and sear contact surfaces, changing the geometry of some of the trigger and/or hammer and/or sear parts by sanding or filing, modifying and/or changing various springs in the trigger/hammer mechanism. if you're not careful you can end up with a pistol that slam fires or can go full auto
And once you've modified the parts the only way to go back to a "normal trigger" is to put factory original type parts back in.
So the gun wasn't "on hair trigger". Could it have had a hair trigger? Sure, but I doubt it. The only person who really knows is the guy who owns/owned the gun.
What I do know is The Dude took a gun from someone and broke 3 of the 4 rules:
Every gun is always loaded.
Keep your finger off the trigger until ready to shoot.
Keep the gun pointed in a safe direction.
If drugs and/or alcohol were involved I'm not buying the "hair trigger" story.

I was raised with guns having been taken to the shooting range from a very young age, I was obviously in the army, and for ten months of the year prior to this incident I had a fully automatic machine gun with me day and night, that I had to use and keep clean and "clear" multiple times daily when entering chow halls and such. I slept with it every night, and if I had to go somewhere without it, it would require a sitter. So I know friggin guns Einstein.

Yes scoot. I am aware. That is why I put the quotes around "accidentally." The scope and subject of the entire post was how intent is relative to penalty. I used the loaded gun example in reference to the weapon most commonly involved in negligent discharge, Glock pistols. The act of pulling the trigger to release the slide in the process of breaking down the gun is, in and of itself, in violation of the rules. Glock makes a fine gun. But that is a flaw. My point being that there are a wide degree of variations in intent and negligence. Someone cleaning a Glock, who simply mistakes the order of operations in breakdown (rack, drop mag, release slide instead of drop mag, rack, release slide) and kills someone downstairs through a floor is less culpable than someone who picks up a gun and pulls the trigger.

In the sanctity and privacy of my home at the time, which was a red brick, cinder block, and concrete on steel floor building with load bearing walls made of cinder blocks, on the second floor. I could have pointed a 45 at the ceiling or floor and unloaded an entire clip and not one round would have left my apartment. I was within my legal rights and although I wished I'd had a scooter round, excuse me, dummy round rather, I'm not certain a plastic round would have acted the same way. Perhaps they make more accurate dummy rounds than the plastic ones I saw, but I only saw plastic at the time.

It's also very difficult (if not impossible) to become a citizen of Thailand as far as I know. I'd still like to live there for a while at some point in my life and I talked a lot with my friend from Wales about that when I was in Thailand with him. He had been living there for a year or two. What 99% of the non-citizens who live in Thailand do to remain there is very simply get their passport stamped in another country outside of Thailand at some point during the year. There's actually a little shuttle service or something dedicated to doing just that. They bus or boat (whichever it was) a load of people over to Cambodia for a couple of hours, get their passports stamped, then bus them back.

It's not very easy to become a citizen here. It is, however, very very easy to just come here and be afforded all the rights and protections guaranteed to a citizen by the constitution. In some cases, including this one, they are afforded more rights and privileges.

I was thinking about it earlier and I came to a similar conclusion. I like the idea here and it did work, however as with most parts of how my country operates, I feel things are in dyer need of attention if not total teardown and reassembly.
I originally was referencing Finland's judicial system, not their policies on immigration, but I am curious about the subject now. They also did an absolute about face with their educational system, check that out as well. I feel this country could learn a lot from Finland on those two subjects, however I don't think immigration has a "blanket" solution suitable for every country. I think it's case by case, county by country for a reason at the moment. I'd like to see man eventually evolve and walk the earth as a species someday, however it wouldn't surprise me if I am not around long enough to see that.

John as far as immigration goes, the solution is fairly simple in my opinion... Policies that put the interest of the citizen tax payer and nation first, while employing a system that enables the orderly, peaceful, and lawful admission of hopeful citizens who wish to come here for the right reasons. I feel like most everyone who has participated in this conversation has a pretty good idea what those "right reasons" are, so I'm not going to keep regurgitating what we all know.
As far as who we do not want here, people who after evaluation are determined to be most likely to end up being a burden to the nation and taxpayer or those who wish to come here for nefarious reasons. But like the gun control issue and how criminals relate, the majority of ill-intentioned non-citizens are probably not going to the trouble of coming here and staying here legally. Although, I do believe that there are those who believe in jihad here legally waiting to strike. They seem very well versed in using our own systems against us.
Most importantly, these policies must be adhered to and enforced! NO more sanctuary cities, states, and whatever other anti-American leftist BS they come up with. I don't care if you are the governor of a state or a mayor of a small town, the act of implementing such policies is criminal and should be handled as such.
Hmm...some of that kind of sounds like much of the policies and laws we already have in place, but are ignored..... So we come all the way back around to this point, much like the gun control debate, we need uniform enforcement and compliance with the laws and policies already in place.
It goes without saying but I'll say it again, I welcome those who wish to come here legally with respect to our laws that will work to better themselves. I do not support an invasion of people from south of our border who are most likely to not pay taxes and end up becoming a net liability to those of us that do. This does not make me a racist or hate brown people. This means that I support the rule of law and the idea that it should be applied as consistently, fairly, and as uniformly as possible.
Bottom line is, those who are crossing into our country illegally are not coming here to become contributing citizens and must be stopped.

Scooter asked about Mexico. It changes every once in a while, but he's my latest understanding of it...
You can get the equivalent of a green card if:
- If you want to work at a job like teaching school, but it has to be for a company that employees at least 9 Mexicans
- If you are a manager or have some other business specialty, this negates the 9 Mexicans rule
- If you open a company in Mexico, but you MUST partner with a Mexican even if it is a silent partnership That goes for all companies, even WalMart and GM. You need to prove the company has a start up capital of about $150,000 to do an S.A. de C.V.
- If you are retired and can prove an income of (changes based on minimum wage, but its about $15,000 ISD a year last I looked
You can apply for citizenship after having an FM3, or Immigrante Permanente card for 5 years (might only be 3 now). You then apply for an FM2 and it can take 3 to 5 years to get citizenship after that. My understanding is that you do need to take a Spanish language and history test as well, unless you are over the age of 65.
If you are married to a Mexican, or have a Mexican child the process is supposed to be faster.
- If you are kidnapped, forced into slavery or suffer some other hideous act while in Mexico you are offered citizenship. Don't laugh, the people coming up from South America suffer through some crazy stuff while heading North. They either have to pay, or hide from the Narcos all the way up. If they are enslaved to work on pot farms and are lucky enough to be rescued they qualify for citizenship.
- You are obligated to carry your status card around at all times and report to the authorities any time you leave and enter the country.
- People with "serious" criminal records are not allowed into Mexico. The reporting varies, but for example I've heard there are people with dual citizenships that have been convicted of child molestation in the USA and are not allowed back into Mexico. Seems hard to believe, but that's what I was told.
I haven't bothered to apply for citizenship as I have permanent resident status, but I'm thinking about it as it would allow me to own a gun legally and if I ever cash out here it would save me about 30% in taxes. You are obligated to pay taxes in Mexico if you reside here even if the income is generated outside the country. However, if you make less than $20,000 a year you don't even have to file and I think they are raising that ceiling.

You might be surprised at how many people think I simply crossed a border and landed in paradise just because I left Canada. Hard to get it though their heads that life is what you make of it and not what it makes of you.
