View Full Version : Question about solving a atc350x purchase problem?

Hi Guys
I have a question about buying a 3 wheeler through craigslist. I saw an add on craigslist for a atc350x parts bike that runs. Now the guy that I bought( with a money order) the 350x from is now giving me the run around about the bike. He hasn't answered any of my emails or phone calls for the last week and a half. About 3 weeks ago I asked him to send me some pictures of the bike broken down into 4 parts boxes for shipping. He still hasn't sent me any pictures of the bike parts that he claims to have all boxed up and ready to ship but is always to busy or camera is broken, forgets to ship it out that day etc etc. I know the guy is around because I phoned his home # and his mom told he been home this past week. I have given him firm deadling dates for shipping out the bike to me but they have come and gone and now he doesn't seem to want email or call at all. Has anyone had/gone through this before and if so what did you do to get the situation corrected. I know that a person can go to a sheriff but this is an out of state purchase. What's the best approach to solve this matter.

Yeah, i'd say if he is close to you, go strait to his house. If not, start calling the house a lot, and ask his mom whatsup. Has he cashed your money order yet? Is there any way if finding that out?

go to the post office and file mail fraud. charges call his local police. file a complaint with your local police.

Call the sheriff/police in his city/town and tell them what is going on. Give them all the info you have about this guy, full name, address, phone number, how you paid him. Hopefully you used a U.S. Postal money order and kept the receipt.

if it was a postal money order its a federal offence if you dont try to make everything right and or are scamming

IT's in the California near L.A. and I paid by a U.S. $$ bank money order. I do have all the reciepts and emails he sent me that he received the money order and that he was taking the bike a part to ship. I am not close enough to go see him, I wish I was but I am not. Well, I guess I ll just keep phoning his house or I guess its his mom's house and let her know what's up and if that doesn't work in the next day or two, then I ll have to talk to sheriff in his town or county and get the ball rolling in that manner. Sorry, I double posted didn't mean to. I am going try calling his house or his mom's house and let her know what's going on and if that doesn't work then I ll get the sheriff involved. I ll try to get a hold of the guy tomorrow hopefully. Is anyone near L.A. california because I would take someone up if they offer to go and pickup the bike for me.

L.A. area awww for get it ... cops have way to much crap going on to worry about this...
Best bet is to have someone near by pay him a visit ... ( lets hope he's not a Gangster ) is so your life worth more than what you sent him .

go to the post office and file fraud charges
you paid him by mail it doesn't matter what kind of money order you sent
MAIL FRAUD - 18 U.S.C. 1341, makes it a Federal crime or offense for anyone to use the United States mails in carrying out a scheme to defraud.
A person can be found guilty of that offense only if all of the following facts are proved: First: That the person knowingly and willfully devised a scheme to defraud, or for obtaining money or property by means of false pretenses, representations or promises; and Second: That the person used the United States Postal Service by mailing, or by causing to be mailed, some matter or thing for the purpose of executing the scheme to defraud.

File a complaint with the Internet Crime Complaint Center www.ic3.gov They will forward it to his local law enforcement for follow up. I would also talk to your local postal inspector.

HI GUYS
Sorry, for not giving an updating sooner but the I did receive the 350x about 2 weeks ago. It's amazing what a call can do to someone's mother. I called the guys mom(I guess he lives with his mom) and gave her the details on the matter. She told he wasn't home the night I called her but that he would call me the following eveing and if he didn't then just to call and let her know that he didn't return my orginial 5 message and she would getting the matter resolved quickly. Low and behold the guy called me that night and said that he would have everything ready to go for shipping the bike out to me in 3-5 days. On day #4 of the 3-5 day time table he called to say it was shipped out and that I would get it in a few days. No if ands or buts about the matter after I spoke with his mom. So, thank you to his mom for getting this matter resolve and completed without more hassel from the guy.
It's nice to see that there are people out there that still have manners and respect to honour a deal that was made via emails and phone calls.
Take it easy 350XMAN!!!

I would have told her about it the first time I got her on the phone. I am 25 and I still wouldnt want my mom on me about something like that.
