200x choke problems

took my new 200x for a ride today and after about an hour of riding the choke kept flippin on . ended up tying it to the shock resivoir tube. anyone know what is causing this?

on the lever there are notches that hold it in the 3 diff. positions, those notches are prolly work or the lever is bent/loose
