I've refiled to get my zoning back for my mx track. My hearing is November 20th. I'm still away from home working and won't be back until Tuesday morning so I'm gonna be pretty much SOL for planning time. I've heard the opposition is already organizing against me and I'm sure they have all kinds of elaborate plans. Wish me luck.

I want to get up there and do a race or two sometime, been wanting to do it for years but it just hasn't been plausible. I've been riding it lately with my TRX, but I'm putting my blue framed 86 ATC back together right now so I can hit some of the stuff up over there on it.

Welp guys, I'm going back in AGAIN, tomorrow night. 6:30PM. Say a prayer for me. We were suppose to have a full board but there was a family emergency on Monday that is keeping a board member from showing up. So we have the chance for a tie again, which will mean rejection of the application.

I've been writing and writing and think and thinking and thinking and thinking so much about this whole damn thing my head is about to EXPLODE. I'm nervous and worrying of course...The turnout looks to be a bit better this time. Theres going to be some more riders and a handful of Pro ATV Racers that are going to speak in favor of it so hopefully that will go a ways with the board. Perhaps they will be surprised when I hand them a magazine and the guy on the back cover is standing in the audience.

Hopefully they will realize that in this tough economy where all towns, cities, villages are in desparation mode to create revenue. This may be a viable way to create cash. And thats what everything comes down to. It would be poor planning on their part for them to turn down business. I hope everything turns out well for you and your family this time around.....:beer

3/1 Rejection. Permit has been denied. Lots of riders and racers there, but it wasn't enough. Meeting was almost 9 hours long, a record by considerable amount.

just make it a requirement that use of the track has to be done with factory exhaust. I'm sure factory pieces meet sound requirements. looks like that is whats holding the permit up

What does this mean? They watched your video presentation and deemed it too loud?

I took readings at various locations with my own db meter while there was riding on the track. Supposedly, it was a level that exceeded what the LDR book specified. However, the LDR book states that it has to be done with a certified meter that is in conformance with the ASTM standard, and performed by a person certified. Noise generated by road traffic, also has to be tested as a baseline to compare against whatever is being emitted from the property. I did my own independent testing with my own meter and reported the results to the board at the meeting, that WAS NOT capable of meeting the requirements the LDR book states for the noise ordinance. They did deny the permit on account of noise, but this is the first I'd heard that they were basing it on information I had provided. Thats pretty laughable.

I mean, I can hear the interstate from over a mile away pretty easy myself. It's amazing how all it takes is one whiny person to ruin things for many.

I hope you come out ahead on this Billy. It's a damn shame what's happening to our fine country with crap like this over the years. I'd bet that the person that's complaining moved in well after you were there too.
