The Consent Decree is what you are speaking of, and that was the arangement back in the day...
Fastforward to 2008: there was a bill passed that was primarily concerned with lead paint in childrens toys. It also included a specific ban on 3 wheelers:
"‘(c) Requirements for 3-Wheeled All-Terrain Vehicles- Until a mandatory consumer product safety standard applicable to 3-wheeled all-terrain vehicles promulgated pursuant to this Act is in effect, new 3-wheeled all-terrain vehicles may not be imported into or distributed in commerce in the United States. "

For one of the big manufacturers to get back into the game, they'd have to work on the "Safety Standard" referred to in the bill. Who knows what amount of effort that would take...
