ummmm...news flash...ALL my claims and stories are true, in FACT, other people on the site including Mickey Dunlap and John Neary proved that at least two of them, which were the FACT that I did work in the R and D department at Kawi, AND that I not only raced 3 wheelers, I raced them in the PRO CLASS. John Neary even has a video that shows me holeshotting the PRO 3 wheeler race in San Diego which had several of the top riders there including Jimmy White. You can also find my name online in the race results for the PRO Motocross class if you do a Google search of my name and Cycle News Magazine which I gave your wife my personal password for because it cost money to view the entire magazine online and she wanted to check it out before she paid for a subscription to see if she wanted it. So yup, I am an asshole because I offered to do your wife a favor even while you were being your typically azzanine self bloviating and pontificating after sometimes prefacing your entertaining comments with the statement, "I just have to get this off my chest.".

In addition, if I recall correctly, which I usually do, it was YOU whom posted that if it was ever proven that I worked at Kawi in ANY capacity, you would apologize. Well, since you definitely saw Mickey Dunlaps ridiculous and childish thread about me, you know for a FACT that I did work there, yet I have still not seen an apology from you, or whomever made that comment.

Here's some more FACTS fer ya to gesticulate over since you seem to have such a great interest in me. I also write music and lyrics and play guitar, piano, and drums, AND I was the opening musical act for a show, albeit it a small one, that Robbie Krieger from The Doors played at with his band called The Doors Of The 21st Century (in which he had a singer that looked and sounded similar to Jim Morrison), after I was asked by the promoters to play there, so put that in your bottle of Pine Sol and swallow it.

Intent is one factor that attorneys use to determine the charges against people. I'm reasonably certain that the guy that turned the restaurant into a drive thru had no "willful" intent to do so but that does not mean that he was not intentionally negligent. It's certainly not as if his brakes simply failed through no fault of his own because of a defective part, in which case, the part mfg could be held liable under some circumstances. I, and I'm sure many others here including yourself are aware of cases where mfgs have been sued due to injuries sustained because of a faulty part. Most everyone is aware of the flaming Ford Pinto law suit as one example. When I worked at Kawasaki we were in the initial stages of being sued by some police officers that crashed while pursuing someone on their police bike because they claimed it was unstable at high speeds.

I was part of the test team that had to test the bike to see if the claims were true, and we ultimately proved they were not, however, I did do some modifications to the bike that increased high speed stability which Kawi incorporated into the next years model. Then there was the eternal lawsuits over KH500, aka, "The Widow Maker.".

Anyway, intent was certainly a question the jury legally had to consider in the Steinle case, and since they couldn't prove the guy intentionally shot her or had any intent to shoot anyone, they certainly couldn't convict him of murder/homicide in any degree.

Someone here asked about charging the shooter in the Steinle case with involuntary manslaughter, and it was one option given to the jury by the Judge, however, by California's definition of that law, the shooters actions may not have met the necessary criteria to be charged with manslaughter as horrendous and repugnant as that may seem to some.

The link below is the actual law pertaining to manslaughter in California.

Below is 142 b. Is this what you are referring to?

    (b) Notwithstanding subdivision (a), the sheriff may determine whether any jail, institution, or facility under his or her direction shall be designated as a reception, holding, or confinement facility, or shall be used for several of those purposes, and may designate the class of prisoners for which any facility shall be used.

IDGAF what you done, do or will do..You could have invented the friggin wheel for all I care. You came on here and totally clashed with the overall mojo of the site, much Like Dunlap did...
Aside from all his intricacies, he was smart enough to pull back from the non accepatance of the group, and Despite all the drama that follows that guy, he has a bigger name than you ever did in the sport and still continues to at least offer products and services relative to 3 wheeling. This place has become a beration pot for anybody making progress, torched them in fire, ran em off, and has now become the proponent of protecting, ignoring and tolerating some of those behind that..I can not blame the admins really for allowing you 2 clowns to run rampant. You 2 guys alone single handedly ran down the energy level of anybody trying to curb your BS.. as Billy stated..Nothing can be done but let you trolls continue to crap the place up until you get bored with it or find your level of gratification elsewhere that you so desperately seek..Unlike you 2 clowns, a team of 6 moderators and 3 now removed from that posistion, have a life that prohibts them from monitoring your guys 2 dozen accounts to sift through and stay on top of keeping you guys gone for good.....Until then everyone you guys offend or aggravate are left to tip toe around your existence here..

The difference between you and the rest of the old pros, they never hid behind a false name, location , nor were banned from a dozen other forums. You and your butt buddy have added nothing but shear controversy to this place. Stay here, have what smoldering pile is left. Tell em all you invented the trike, tell em to adjust thier timing on a 250R, tell em all forks except the almighty tecate forks suck. Tell em you been stabbed, rode a trike 800 miles on the road..Shove it down their throat chokingly like they owe you something and are not worthy of having the priviledge to say anything in here otherwise without giving you credit first.

If they are gullable enough to buy into your deep throat mentality of 10 seconds of football stadium stardom on a 3 wheeler unloaded from a 79 chevy G van, fine that is their mistake. Apparently the admins here have not found anything worthy of your past that quantifies your own thread and special little star...So what ...you played guitar. So do I..You want a friggin medal? I may have disputed you didn't work for kawi..However, I have heard more stories of you being more of a custodial arts engineer that probably badgered the higher ups so much, they threw you on a trike so you could grab your holeshot and STFU...I have holeshots all over the web too. Who friggin cares? None of this makes you expemt from the fact your convert oxygen to Carbon dioxide and will be nothing but worm food in the end. Forgive me for not bowing down to your "not for reprint" existence...
I wiped my ass last week without getting any on my finger...Who friggin cares really.

Once again.. you....Banned many many times..duplicate accounts, no edit button, banned from other forums only to continually return much like Glenn Close in her stalking movie..Me same name, my name...same account 12 years strong now buddy...Who is the mentally unstable one in that equation really?
Here is where my long useless list of stuff nobody cares about should go...

I've liked Barnett from the beginning and he seems to fit in really well. I dare say he's in more of a position to speak of who and what is relevant on this site than someone who doesn't consider himself a part.

Here it is copy pasted directly: (b) Involuntary—in the commission of an unlawful act, not amounting to a felony; or in the commission of a lawful act which might produce death, in an unlawful manner, or without due caution and circumspection. ok, sure that makes sense, however, as everyone knows, there are many hours of testimony at a trial like this, so without actually being there the entire time, or having the complete transcripts including the judges instructions to the jury etc, it is just not possible for outsiders to know for certain why a jury voted one way or another. Obviously even with the same info, the jurors still don't always agree with each other which can end up in a hung jury/mistrial etc.

The term "accident" is the most misused term I can think of.

First off, running a red light and t-boning another car IS NOT AN ACCIDENT. It was caused by the driver being negligent in the VERY IMPORTANT task of SAFELY OPERATING A MOTOR VEHICLE. Being negligent negates the term "accident".

I mean ffs, how much warning do you need to figure out that a light is turning red?

Federal guidelines recommend yellow lights last from 3 to 6 seconds. Local authorities set the duration based on many factors including: traffic volume, speed, roadway grade and intersection design.
3 seconds appears to be at 30 mph, 6 seconds appears to be at 55 mph

Spare me the bullsh!t that yellows are too short. I've been driving plenty long enough to know that if you are going the speed limit there is plenty of time to stop on a yellow before it turns red, and I'm a guy who regulary runs yellows.

You all know I'm right. (Yes, I know there have been some cities caught shorting yellow times to generate ticket income, but that's a different thread.

    So, That said:

There are four rules for safe handling of guns:

    The Four Rules

    All guns are always loaded.

Never point the gun at anything you are not willing to destroy.

Be sure of your target and what is beyond it.

Keep your finger off the trigger until your sights are on target (and you have made the decision to shoot).

Dude broke three of the rules in his "incident".

Being young and dumb is not an excuse. You can bust my chops for being hard on you all you want, you're one lucky guy no one got shot and died. You could have passed on taking the gun.

Quote Originally Posted by The Dude View Post

There is no such thing as a gun being "on hair trigger". It either has a trigger with a modified pull weight or it doesn't. They don't come from the factory with a "hair trigger".

The Ranger was on his way to a temporary assignment in Helena, Montana, and stopped off in San Francisco.

The Ranger didin't "lose his gun" it was left (from testimony)
in a holster inside a backpack stashed under the front seat of his SUV parked on The Embarcadero near Pier 5 while the family went to dinner.
When he returned, two of the vehicle's windows had been smashed and the backpack with the gun inside was missing.
    (more from testimony).

"It appeared to be at the time a safe location," Woychowski said. "It was well-lit and metered and there were other pedestrians in the area, which made me feel safer."

Woychowski said he also spoke to someone he took to be a meter maid or security guard in the area who said he would be patrolling until 11 p.m., and took that as additional assurance his vehicle would be safe.
So what more could the guy do to prevent the theft of his gun?

HEY! I know! How about people just not break into other peoples cars and not steal other peoples stuff? They should make it illegal. Oh, wait.

The scumbag originally told police he was shooting at a sea lion, then changed his story. He then said it went off when he stepped on it. His lawyers then said ti accidentally went off as he held it.

He threw the gun into the ocean after the shooting.

He hurled it into San Francisco Bay, not to hide his crime, as prosecutors contended, but because he was scared by the noise of the weapon.
During deliberations, according to the Chronicle, jurors asked if they could test the trigger of the pistol, presumably to see if it could fire accidentally. The judge denied the request.
    What a crock of sh!t
