and if you look at the picture in the auction but I got this in mail instead , is this a picture of fellow member's ATC250R ? I was just curious because it looks so familiar and if so... it's one great looking 250r !

Thats funny. I have that picture blown up to poster size in my garage. It was taken in 1999 or 2000 at Silver Lake Sand Dunes. That picture has been all over the place. I really don't care if someone uses it and I know a lot of people have it.
I guess he liked the picture. The person could have asked before using the pic, but I doubt that they knew where it came from. Like I said, that pic is everywhere.
