not 100% sure, but you can't have a "live" axle and be road legal.(4 wheeled vehicles) You CAN have a 3 wheeled vehicle with a live axle. To make your quad legal, it would have to have a rear differential and not just a straight axle, like most sport quads. This may not be the same laws in every state, but in general I think that is the biggest reason for them being hard to license. Call the local state police and ask them...they should be able to tell you, or at least give you some info to go to the Public Library and do some research.

For a Motor vehicle, motorcycle, etc. MOST states require this:

    1. You need DOT approved tires (and wheels). Not the low pressure tires
    that atvs have.
    2. Brake light, tail light, headlight with high and low beam, turn signals.
    3. No live axle
    4. Title, registration, and insurance if applicable. Many atvs come only with
a certificate of origin, NOT a vehicle title. Good luck with all
    that.
    5. Weight. A motor vehicle has a minimum weight (and even size)
requirement in every state. Atvs do not meet this requirement. And no,
you cannot add weight to make it legal.

Long story short, only a few states allow them on the road, and it is usually limited when they do. Your local Department of Motor vehicles should be able to tell you more.
